An Ordinance defining and prescribing the punishment of cer-
tain misdemeanors.
Be it ordained by the Council of the Town of Edmonds.
Offenses against public peace and quiet.
v SECTION 1: (Division 1) Any person or persons who shall be a4b"t'ff
guilty of any assault and battery, as defined by the laws of
Washington, within the corporate limits of the Town of Edmonds, `j`

upon conviction thereof before a Police Justice of said Town,
,(� shall be.punished by a fine of not less than five ($5.00) dollars,
U nor more than one hundred (100.00) dollars, or by imprisonment
not exceeding thirty days, or by both such fine and imprisonment.
�a � VSECTION 2: Every person within the limits of said Town who
�� shall feloniously steal, take and carry, lead or drive away the
:l personal goods or property of another under the value of thirty
($30.00 ) dollars, shall be punished by a fine not less than twenty
five 025.00) dollars nor more than one ($100.00) hundred dollars
�yt or by imprisonment in the Torn jail not more than thirty days or
by both such fine and imprisonment.
- ` d"04 VSECTIC.0 3: Whoever shall be guilty of fighting, drunkenness,
w or any indecent, riotous or disorderly conduct, or any conduct
� t {O Mending to debauch the public morals or to a disturbance of the
peace, or who uses any profane, abusive or obscene language whereby
the peace or quiet of the Town may be disturbed, or who shall be
guilty of any indecent or immoral act or practice in said Town,
alrshall upon conviction thereof,before a Police Justice, pay a fine
ynot more than one hundred ($100.00) dollars or be imprisoned in
the Town jail not exceeding thirty days or both.
�a k SECTIOJ 4: 17hoever shall, within the Town, carry or wear
under his or her clothes, or conceal about the person any danger-
ous or deadly weapon, shall be fined in any, sum not .exceeding one
p hundred ($100.00) dollars, or be imprisoned not .exceeding thirty

C-1�CVSECTION 5: Whoever shall, within theTown of Edmonds, draw
C any species of fire arms or any dirk, dagger, knife or other
- � dangerous or deadly weapon, on the person of another, shall be
subject to a fine of not less than five ($5.00) dollars and not
more a n one thirtyhundred days, or be both dollars r be both finedandimprisoned. not ex-
ceeding VSECTIOJ 5. If any person shall threaten or traduce another
z or shall use any language or indulge in any conduct towards
�e�Q, another tending to produce a disturbance of the peace, or shall
challenge another to fight, or if any two persons shall agree
to fight or shall by agreement actually, each person so offend-
ing shall, on conviction, be fined in any, sum not less than five
( 5.00) dollars nor more than one hundred ($100.00) dollars, or
be imprisoned not exceeding thirty days, or be both fined and
imprisoned.
)"'SECTIOU 7: All persons who shall collect in crowds within

ing any street or sidewalk, or who shall refuse to.disperse
when so collected after being requested so to do by any town
evvi'officer, shall be severally fined in any sum not less than five
($5.00) dollars mor more than one hundred ($100.00) dollars.
AtA k SECyION 8: Every person who shall keep any house or place
of business wherein loud or boistrous noise is made after the
Ze4""hour of eleven o'clock P.M. or wherein riotous or disorderly
conduct, drunkenness or fighting is, or may be suffered,or any
house of public resort'wherein'the peace, comfort or decency of
the immediate neighborhood is, or may be, habitually, disturbed,or
whoever shall keep any inn,,bar-room or saloon',in a,disorderlp
manner, and any -person whoever lets any.apartment or tenement -or
having,the control thereof, shall permit it to be used as in this
section prohibited; is punishable by a fine in any sum not less
fwa4 than five . (S5.00) . dollars_:_ nor more than fifty ($50400 ) dollars or
y imprisonment not exceeding twenty days or by both.
(Division II)
Offences against public morals and decency.
`SECTION 1: Whoever shall appear in any public place or in
any place exposed to public view within said Town in a state of

nudity or in an indecent or lewd dress, or shall make any indecent
exposure of his or her person, or be guilty of any lewd or inde-
cent act or behatior, shall, on conviction,be fined not less than 1�c7� cy
five dollars nor more than fifty dollars. I
SECTION 2: Whoever shall in any manner or by any means be
guilty of cruelty to any dumb animal, or shall be guilty of turnirgJ41z
out and abandoning any old or decrepid or worthless animal upon
the public streets of the town shall be fined in any sum not ex- ceeding twenty dollars.
SECTION 1: g ny�
(Division 3) Whoever shall fire or discharge a � u-l�
cannon, gun, pistol,'revolver, or any firearm of any description,
or shall fire, explode or set off any squibb, fire cracker, tor-
pedo or other thing containing powder or other explosive material,
without permission from the 21dayor or common Council so to do,
within the Town of Edmonds, shall, on conviction, be punished bya d� �
fine of not less than five dollars nor more than fifty dollars. /
y SECTION 2 71-hoever shall lay out or expose any kind of poison
or leave exposed any poisoned food and/or drink for man or beast& 3 r4,-r"
or any substance or fluid whatsoever, whereon, or which there is, �
or shall be deposited or mingled any kind of poison or poisonous,
or deadly substance or fluid whatsoever, on the premises of another,
or in any street, alley, highway, or uninclosed place within the
limits of said town, or whoever shall aid, or abet any person in
any of the offenses in this Section -prohibited, shall for each and.
every such offense, be fined in any sump not less than twenty
dollars nor more than one hundred dollars, or be imprisoned not ex-
ceeding thirty days, or both.
General Provisions (Division) Whoever attempts to commit axy �p
offense prohibited by any Ordinance of said Town of Edmonds, and Wit,'
does any act towards it, but fails or is intercepted or prevszted ir�
in its e-ocution, where -no express provision is made by Ordinance
for the punishment of such attempt, shall be punished by a fine of�y�y
not more than fifty dollars or by imprisonment not exceeding
thirty days, \or by both.
-/-*"'SECTIOff 2: Hembers o*f the police Department shall have a 4,-w
right to demand of every person found abroad in said Town o-f ��C1
Edmonds after eleven o'clock at night, the reason why, and the �
business on which such person is abroad, and if such person shell
fail or refuse to give a good anA satisfactory account of himself,
and satisfactorily answer for being so abroad, he shall be subjeo; P Wkl.
to a fine not exceeding one hundred dollars; and if such officer
shall be satisfied that the .public good requires it, he shall, ar
(first having explained his official character) arrest and detain
such person for further examination, the object of this Section
being to protect the town from burglars, robbers and other
criminals.
V'SECTION 3: All persons who tell fortunes or keep houses q4t"
where lost or stolen goods may be found; all common prostitutes�p
keepers of bawdy house or houses for the resort of prostitutes; Vw
all habitual drinkards, gamesters, or other disorderly persons; all
persons wandering about and having no visible calling or business
to maintain themselves; all persons going about as collectors of
.Alms for charitable institutions under any false or fraudulent
pretense; all persons playing or betting in any street or public
or open place, at or with any table or instrument of gameing at
any game or pretended game of chance, shall be deemed vagrants;
and any person who shall be convicted of being a vagrant shall be =;
-,fined not less than five dollars nor more than one hundred dollars a,147
or be imprisoned for any time not exceeding thirty days, or be
both fined and imprisoned.
SECTION 4:All offenses probbited by this Ordinance are hereby eo�
declared to be misdemeanors and in all cases of conviction for any
of the offenses mentioned in this Ordinance, and of any other
offenses against the authority of said Town, the Court shall ad-
judge the offender to pay the costs of prosecution and shall in

default of payment of any fine and costs, commit the offender to
the town jail until the same shall be paid not exceeding thirty
- days, except where otherwise specially provided.
e �y,�,,�� SECTI0N 5: Upon rendering judgment for any fine, forfeiture
JLi r penalty for the violation of any Ordinance of said Town, the
J7Z_51�eiustice before whom the conviction is had shall require immediate
payment of such judgment and shall make an order that the defend-
ant stand committed until the fines and costs be paid not exceed-
ing thirty days, which order shall be entered upon the docket of
such .sustice as a part of the judgment in the causeand the defend-
ant,ii present, shall not be permitted to depart from custody ex-
cept on payment of such judgment, or upon filing an appeal bond
and approved by the Justice as provided by the laws.of Washington.
4,,- "'` y VSECTIO l 6: Every person sentenced for an offense under any
of the Town of Edmonds, to imprisonment, or who shall be

"In default in the payment of any fine, shall be commited to the
custody of the Town Marshal under whose supervision he shall be
required to work upon the public streets, or other:public grounds,
or improvements of the town at least six hours and not more than
eight hours of each working day during sudh-term of Imprisonment,
or at the rate of one dollar per day until such fine is paid, not
exceeding thirty days.
P SECTI0N 7: Every term in this Ordinance implying one only
shall,when re,:_aired, be construed to mean two or more and. any
Leyterm implying two or more, shall also be construed to mean, when
required, but one, except in cases where two or more are necessary
to constitute the offense, and every term implying sex shall,
when necessary be construed to mean both or either; and the worm
person shall be construed to include any public or private cor-
poration as well as individual.
That this Ordinance shall take effect and be in force from
and after its passage, approval and publication.
Passed by the Council of the Town of Edmonds the 21st dayof
June 1892.
