Ordinance 0339ORDILALCE N 0. 339 . ( L. I . D. 28 ) An Ordirarce providing for the re -assessment of all property in Local Improvement District Lo.28 of the Gity of Edmords, as established by Ordinance No.322 of said City, and of all property within the City of Edmonds specially benefitsd thereby; asd direct- ing the preparation of an assessment roll therefor. The City Council of the City of Edmonds do ordain as follows: SECTION 1: Whereas, under and pursuant to Ordirance Lo.322 of the City of Edmonds-, Washington; the Alley between Third Street and Fourth Street from Main Street to Dayton Street; also sewer course running along the property line 120 feet South of Main Street from said Alley to Fourth Street, have been improved by the construction upon said Alley and serer course, within the limits mentioned, of a lateral sewer system thereon, and whereas the assessments heretofore levied upon the property in Local Improvement District E o.28 have, through inadvertence and mistake, 328 beer ir_adequate„to meet the cost and expense thereof. SE02IOE 2: E ow, Therefore, it is ordered that the property within Local Improvement District 11,0.28 as created under Ordi- nance No.322, of the City of Edmonds, and all other property with- in said City which has been specially benefited by such improve- ment, shall be re -assessed for the true amount of the cost of said improvement. SECTIOr 3: That an assessment roll be prepared as by the laws of the State of Washington and the Ordinance of said City provided, which roll shall include all of the property specially benefited by such improvement, and which roll shall be based upon. the actual cost of such improvement. SECTI011 4: All sums heretofore paid by the owners of pro- perty within said Local Improvement District Lo-28, under the assessment roll heretofore confirmed by the Council for said District under Ordinance Io.322, shall be credited upon the assess- mer_ts charged against such owr_er upon_ the reassessment roll, and it the evert the reassessment shall be less than the original as- sessmert, then the amour_t of such excess payment shall be re- funded to the owner of the property -so -over assessed. SECTIOL 5: This Ordinance shall take effect and be in full force and effect from and after its passage by the City Council of the pity of Edmonds, its approval by the Mayor and its publi- cation according to iaw.
