Ordinance 0416ORDINANCE N0.416. (L.I.D.45) An Ordinance ordering the improvement of Maple Street in the City of Edmonds., 1 ashington, from the East line of Fifth Street, to the :center lire of Tir.th Street by clearing and grubbing, grad- ing to the full width of said Street except through the out be- tween Fifth Street and Sixth Street where the grade shall be forty (40) feet in width; graveling the full length of the improvements to a width of at least twenty (20) feet; installing tiling, pipes, sewer connections, inlets, manholes, catch basins, culverts and any and all other drainage works necessary to the construction and maintenance of a suitable grade and road surface and doing all other things necessary to make a complete improvement all in ac- cordance with and pursuant to a majority petition filed with the City Council on the Seventh day of r:ovember, 1928; creating a Local Improvement District for said improvement and providing that the payment therefor shall be by the "Payment by Bond" plan. The City of Edmonds does ordain: SECTIOL 1: That Maple Street from the East line of Fifth Street '374 to the center line of i;irth Street in the City of Edmonds, be im- proved by clearing and grubbing, grading to the full width of said Street except through the cut between Fifth Street and Sixth Street where the grade shall be forty (40) feet in width; and graveling a full length of said improvements to a width of at least twenty (20) feet; also installing tiling, pipes,sewer connections, inlets, manholes, catch basins, culverts, and any and all other drainage works necessary to the construction and maintenance of a suitable grade and road surface and doing all other things recessary to make a complete improvement all in accordance with the plans and specifications as prepared by the City Engineer of said City and in accordance with and pursuant to that certain petition for said improvement filed with the City Council of Edmorde on the Seventh day of Iovember, 1928, which petition is signed by the owners of more than a majority of the lineal frontage upor the improvement to be made within the limits and area of said Local Improvement District herein- after created. SECTIOB 2: That said improvement be made along and in front of the following described property which will be effected by said improvement and which will be included within the improve- ment district herein created and limited to such property for the purpose of assessment as hereinafter provided,towit: The South Half 93*) of Blocks Seventy-six (76), Eighty-nine (89), ninety-six (96), and One Hundred Twenty-one (121); also the E orth Half (L 2 ) of Blocks Seventy-five (75) , L inety (90), rinety-five (95), and One Hundred Twenty-two (122), City of Ed- monds, oomprising all of the lots fronting upon the said improve- ment between Fifth Street and E irth Street in said City. SECTI01 3: That the cost of said improvement shall be as- sessed against the property above described, and against all lots, tracts and parcels of land lying and being within the improve- ment district hereinafter created in proportion to the benefits derived therefrom as provided by the Ordinances of the City of Edmonds and the laws of the State of Washington. SECTIOF 4: That the mode of payment shall be under the "Pay- ment by Bond" plan by which plan Bonds of said district shall be issued payable in ter. (10) equal annual payments or installments with interest thereon at the rate of seven (7%) percent per annum. SECTION 5: lhat the estimated cost of said improvement is the sum of Eire Thoasand Four Hundred Eighty ($9480.00) Dollars. SECTI(}TG 6: That there is hereby created a "Local Improvement District" to be desigra.ted and known as Local Improvement District No-45, which shall include all the property hereinbefore described. SECTI OV 7: That there be and is hereby created a Local Im- provement Fund to be known and designated as "Local Improvement District Fund r1o.45." SECTIM 8: That said improvement shall be made under the di- rection of the C' dCouroil and the City Engineer and in accord- ance with the pi ars,7specifieations now on file with the City Clerk of the City of !P�cvnor.as. SECTIOL 9: That Bonds to be issued as hereinbefore provided may be delivered and sold to the Contractor doing the work of such improvement in payment of his services or they may be sold by the City Clerk at private sale, provided, however, that the returns from the sale of said Bonds must net the par value of the same, plus accrued interest, and the ptoceeds thereof shall be applied in payment of the costs and expenses of said improvement. SECTI011 10: That the special assessments to be levied as hereinbefore described shall be payable in ten (10) equal annual installments with interest at the rate of sever (7%) percent per arrum, and such installments shall be collected in the manner provided by the gereral Ordinances of the City of Edmonds and the laws of the State of Washington. 375 SECTION 11: That irterest on any preliminary Warrants that may be issued in payment of the cost and expense of such improvement shall bear interest only for the period beginning from the date on which such Warrant shall be issued and erdirg eighty (80) days after the date provided for the completion of such improvement in the contract therefor. There shall be written or printed or such preliminary Warrants a brief notice, designating the date upor which such interest shall cease. SECTI O1[ 12: This Ordinance shall take effect and be in full force and effect from and after its passage by the City Council of the City of Edmords, its approval by the Mayor and its publication according to law.
