AN ORDINANCE PROVIDING FOR THE I1v'1PROV MENT OF TH.r SIDEWALK AREA OF THE WEST SIDE OF THIRD AVENUE SOUTl1 FROM THE NORTH LINE OF NIEL'S ADDITION SOUTH TO PINE STREET l THE CITY OF EDMONDS BY THE INSTALLATION OF CONCRETE SIDEWALKS AND CURBS, IN ACCORDANCE WITH CITY STANDARDS, AND SUCH OTHER WORK AS MAY BE NECESSARY TO MAKE A COMPLETE IMPROVEMENT;. CREATING AN ASSESSMENT DISTRICT; CREAT- ING A CONSTRUCTION FUND THEREFOR; CREATING A LOCAL IMPROVEMENT • DISTRICT FUND THEREFOR; PROVIDING THAT PAYMENT FOR SUCH IMPROVE- MENT BE MADE BY SPECIAL ASSESSMENT ON SAID DISTRICT UNDER THE MODE OF PAYMENT BY BONDS: AND PROVIDING THE RATE OF ASSESSMENT SHALL BE FIXED ON THE BASIS OF THE SPECIAL BENEFITS CONFERRED AS SET FORTii IN R. C. W. 35. 44. 040. WHEREAS, by Resolution of Intention Nu. 129 of the City of Edmonds, passed by the City Council on August 13, 1957, proposing a local improvement district as shown and outlined above, and doing all other work necessary in connection there- with to make .. complete improvement in accordance with the plans and specifica- tions prepared by the City Engineer, and WHEREAS, at the hearing o -i the Preliminary Assessment Roll on said local improvement as provided by Resolution of Intention No. 129, -'1 objec- tion- w filed, but such objection - did not constitute sufficient objection to discontinue the project; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS DOES ORDAIN: Section 1. That certain property in the City of Edmonds be improved by install- ing concrete sidewalks and curbs in the sidewalk area of ti.e West side of Third Ave. South from the north line of Niel's addition to the City of Edmonds, south to Pine St. in the City of Edmonds, in accordance with city standards, and such , ther work as • may he necessary to make a complete sidewalk improvement. Section. 2. That the cost and expense of such improvement shall be borne by and assessed against the property included in the assessment district created in accordance with law, and provided the rate of assessment shall be as set forth in R.C.W. 35. 44.040. Section 3. That there is hereby established a local improvement district to be called Local Improvement District No. 82, which district shall include the follow- ing described property, to -wit: A parcel within the corporate limits of the City of Edmonds, Washington, lying west of Third Avenue and north of Pine Street, particularly described as follows: begianing at the northeast corner of lot 4, Niel's Addition, according to the plat thereof recorded in volume 16 at page 23, records of Snohomish County, Washingt-,n; thence north 89043130 E., 30 feet to the centerline of Third Avenue: thence south 0005100" E., 39.56 feet; thence north 89043130"E., 16. 37 feet to an existing monument in tate centerline of Third Avenue; thence south 0007'00" E. , along the centerlin � of Third Avenue 662. 71 feet to the south • line of section 23, township 27 north, range 3 east, W. M.; thence continuing south 1007'00" E., 13, 525. 48 ft more or less to the north line of Pine St., thence west along the north line of Pine St. 192. 32 ft; thence north parallel to ThirL Avenue 1891. 48 ft to the centerline of Alder Street; thence west along the centerline of Alder St. 8. 19 feet; thence north 0005100" W., 136. 24 ft to the north line of said Niel's Addition; thence north 89043130" E., 154 feet to the point of beginning; Section 4; A special fund is hereby created to be called Construction Fund for Local Improvement District No. 82 _. Into said funds shall be paid the pro- ceeds from the sale of interest-bearing warrants by the City of Edmonds to the purchasers of said warrants. Out of said construction fund shall be paid, by cash warran's, the costs of the improvement as the same shall become due. Section 5: A special fund is hereby created to be called Local Improvement Distz ict Fund No. 82 , which shall consist in the aggregate of the several amounts aseiessed, levied, and collected on the several lots and parcels of land in said local improvement district and the proceeds of the sale of bonds of the aid district. Out of said f=und shall be paid the bonds, the interest thereon, and the entire cost of such • improvement. Section 6: The cost and expense of such improvement shall be defrayed by special z ssessu.ent payable in ten (10) equal annual installments, with interest thereon at no more than the rate of six per cent (6N9) per annum, payable annually, under the mode of payment by bunds, as provided by law and the ordinances of said City. Bonds bearing interest at the rate of no more than six per cent (6N) per annum, payable on or before twelve (12) years from date of issue, shall be issued in payment of the costs and expenses of such improvement, or the City of Edmonds (91) may, at its election, sell said bonds and make payment in cash in the manner provided by law and ordinances of said City.
