AN ORDINANCE PROVIDING FOR THE IMPROVEMENT OF LOTS TWO
AND THREE AND THE NORTH HALF OF LOT EIGHT, AND ALL OF LOT
NINE IN BLOCK TEN, PLAT OF YOST'S FIRST ADDITION TO THE CITY
OF EDMONDS, COUNTY" OF SNOHOMISH, STATE OF WASHINGTON, BY
THE INSTALLATION OF AN EIGHT INCH SANITARY SEWER IN THE AL-
LEY OF BLOCK 10 BETWEEN EIGHTH AVENUE AND B STREET, EX-
TENDING FROM FIR STREET SOUTHERLY A DISTANCE OF APPROX-
IMATELY 280 LINEAL FEET, TOGETHER WITH A NEW MANHOLE FOR
CONNECTION INTO THE EXISTING EIGHT INCH SEWER ON FIR STREET,
AND A LAMPHOLE AT THE SOUTHERLY END OF THE PROPOSED SEW-
ER, AND SUCH OTHER APPURTENANCES AS ARE NECESSARY TO MAKE
A COMPLETE IMPROVEMENT; PROVIDING, THAT PAYMENT FOR THE
SAID IMPROVEMENT BE MADE BY SPECIAL ASSESSMENT ON THE
PROPERTY IN SAID DISTRICT, UNDER THE MODE OF PAYMENT BY
BONDS, FOR MATERIAL USED, LEGAL EXPENSES, ENGINEERING AND
ALL OTHER EXPENSES, EXCEPT AS HEREINAFTER PROVIDED, ALL
IN ACCORDANCE WITH THE PETITION SUBMITTED BY THE OWNERS
OF THE PROPERTY WITHIN THE SAID DISTRICT; CREATING AN AS-
SESSMENT DISTRICT; CREATING A LOCAL IMPROVEMENT DISTRICT
FUND THEREFOR, AND PROVIDING THAT PAYMENT FOR SUCH IM-
PROVEMENT BE MADE BY SPECIAL ASSESSMENT ON SAID DISTRICT
UNDER THE MODE OF PAYMENT BY BONDS.
WHEREAS, by petition duly signed and conforming to law, submitted to the
City Council of the City of Edmonds on 19'0, petitioning for
the improvement, as above outlined, and doing all other work necessary i.: c.onnec-
tion therewith to make a complete improvement in accordance with the plans and
specifications prepared by the City Engineer,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS
DOES ORDAIN:
Section 1. That Lots two and three and the North half of lot eight, and all
of lot nine, in block ten, Plat of Yost's First Addition to the City of Edmonds,
County of Snohomish, State of Washington, be improved by the installation of an
eight inch sanitary sewer in the alley of Block ten, between Eighth Avenue and
B Street, extending from Fir Street southerly a distance of app- ximately 280
lineal feet, together with a new manhole for connection into the existing eight inch
sewer on Fir Street, and a lamphole at the southerly end of the proposed sewer,
and such other work as may be necessary to make a complete improvement.
Section 2. That the cost and expense of such improvement shall be borne
by and assessed against the property included in the assessment district created

in accordance with law, provided, however, that any cost exceeding 10% over and
above the estimated cost of $1900. 00 or $4. 55 per front foot for such improvement
shall be borne by the City of Edmonds.
Section 3. That there is hereby established a Local Improvement District
to be called Local Improvement District No. 83, which district shall include the
following described property, to -wit:
Lots two (2) and three (3) and the North half of lot eight (8), and all of
Lot nine (9), in Block ten (10), Plat of Yost's First Addition to the
City of Edmonds, County of Snohomish, State of Washington, accord-
ing to plat thereof recorded in volume 8 of plats, page 6, records of
said County.
Section 4. A s,_ecial fund is hereby created, to be called Local Improvement
District Fund No. 83, which shall consist in the aggregate of the several amounts
assessed, levied and collected on the several lots and parcels of land in said Local
Improvement District, and the proceeds of the sale of the bonds of the said dis=trict.
Out of said fund shall be paid the bonds, the interest thereon, and the entire cost of
such improvement.
Section 5. The cost and expense of such improvement shall be defrayed by
special assessment, payable in ten (10) equal installments, with interest thereon
at a rate not to exceed six % per annum, payable annually, under the mode of
payment by bonds, as provided by law and the Ordinances of said City. Bonds bear-
ing interest at the rate of not to exceed six ;o per annum, payable on or before
twelve years from t,.e date of issue, shall be issued in payment of the costs and
expenses of such improvement, or the City of Edmonds may, at its election, sell
said bonds and make payment in cash in the manner provided by law and the ordi-
nances of said City.
