Ordinance 1336ORDINANCE NO. AN ORDINANCE OF THE CITY OF EDMONDS* WASHINGTON PROVIDING FOR THE ACQUISITION FOR PUBLIC PARK PURPOSES OF CERTAIN PARCELS OF PROPERTY; PROVID- ING FOR THE AUTHORIZATION OF THE CITY ATTORNEY TO INITIATE PROCEEDINGS FOR CONDEMNATION, APPROPRIA- TION.,0 TAKING AND DAMAGING OF LAND AND OTHER PROPERTY NECESSARY THEREFOR; AND PROVIDING FOR PAYMENT THEREOF. THE CITY COUNCIL OF THE CITY OF EDMONDSz WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The public health., safety necessity and convenience demand that the following described lands be acquired and used for public park purposes: Parcel 1: Lot 1, Block 1, Lake Ballinger Homesites, according to plat thereof recorded in volume 14 of plats, page 99, records of Snohomish County, Washington. Parcel 2: From the following described property, all situate in Snohomish County, Washington, All that portion of Tracts 8 and 9, McAleer Five Acre Tracts, described as follows: Beginning at a point 375' N. of SE cor. of sd Tr. 9; the N 15' ; the W to W In of Tr 9; the N alg sd W In of Tr 91 1401; th W to E In of R/W of Seattle -Everett Interurban RR; th SWly alg sd R/W to W In of Tr 8; th S alg sd W In of Tr 8 to pt W of POB; th E to POB, except county road on the east side, a tract of land described as follows: All that portion of Tracts 8 and 9, Lake McAleer Five Acre Tracts, according to plat thereof recorded in volume 5 of plats, page 48, records of Snohomish County, Washington, described as follows: Beginning at a point 375 feet North of the Southeast corner of said Tract 9; thence North 15 feet; thence West to West line of Tract 9; thence North along said West line of Tract 9, 140 feet; thence West to East line of right of way of Seattle -Everett Interurban Railway; thence Southwesterly along said right of way to West line — 1�4— of Tract 8; thence South along said West line of Tract 8 to a point West of point of beginning; thence East to point of beginning; EXCEPT that portion conveyed to Snohomish County for road under auditor's file No. 823624. Section 2. All lands, rights, privileges and other property within the limits of the lots, blocks and tracts of land described hereinabove are hereby condemned, appro- priated, taken and damaged fcr public use and necessity for public park purposes; and all such lands, rights, privileges and other property are to be taken, damaged and appropriated only after just compensation has been made or paid into court for the owners thereof in the manner provided by law. Section 3. The entire cost of the improvement provided for herein shall be paid by the City of Edmonds from the Park Site Acquisition Fund or, if the monies in said fund are in- sufficient, from any other general funds of the City avail- able thereto. Section 4. The City Attorney is hereby authorized and directed to begin and prosecute the proceeding provided by law to condemn, take, appropriate and damage the ]azd, rights, privileges and other property necessary to carry out the pro- visions of this Ordinance, and is further authorized in con- ducting said proceedings and for the purpose of minimizing damages to stipulate as to the use of the property h eby au- thorized to be condemned and appropriated and as to the reser- vation of any right of use to any owner, provided that such -2- reservation does not interfere with the use of said property by the City as provided by this Ordinance.
