AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON AMENDING THE OFFICIAL ZONING ORDINANCE, SECTION 12.16.130 B,,TO PERMIT ADVISORY RECOMMENDATIONS OF THE PLANNING COMMISSION TO THE BOARD OF ADJUSTMENT ON APPEALS AND CONDITIONAL USE PERMIT APPLICATIONS TO BE DISCRETIONARY RATHER THAN MANDATORY, PURSUANT TO PLANNING COMMISSION RESOLU- TION NO. 277. WHEREAS, the City Council of the City of Edmonds, Washington pursuant to Planning Commission Resolution No. 277 called a public hearing and thereat found it to be in the best interests and the public health, safety and wel- fare to amend the Edmonds Zoning Ordinance as set forth below, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code, Section 12.16.130 is hereby amended to read as follows: "Section 12.16.130 Procedure. A. The City Clerk shall maintain and be custodian of all records of the minutes of the Board, and findings and decisions of the Board. All records shall be open to the public. All appeals from interpretations of the Building Inspector, and applications for variances and conditional use permits, shall be in writing on forms prescribed by the Board and shall be accompanied by $10.00 to cover the costs of processing. Every appeal and application shall refer to the specific provision of the Ordinance involved, and shall set forth the in- terpretation that is claimed, the use for which the conditional use permit is requested, or the details of the variance that is applied for and the reasons for which it is claimed that the variance should be granted, as the case may be. B. At least five days before the date of the hearing on an appeal or application for a conditional use permit before the Board, the Secretary of the Board shall/ may transmit to the Planning Commission a copy of said application or appeal, together with a copy of the notice of the aforesaid hearing, and the Planning Com- mission may., on its own iniative, or at the request of the Board, submit an advisory recommendation to the Board prior to the date of the hearing. C. Any party aggrieved by any decision of the Board who seeks review by the Superior Court shall commence said action within thirty (30) days of the effective date of the decision of the Board."
