AN ORDINANCE OF THE CITY OF EDMONDSr WASHINGTON
ADDING A NEW SECTION TO THE LOCAL IMPROVEMENT CODE,;
SECTION 7.04.140, AUTHORIZING THE CITY TREASURER TO
ACCEPT REDUCTIONS IN THE AREA OF ASSESSMENT FOR
CERTAIN LOCAL IMPROVEMENT DISTRICT ASSESSMENTS WHEN
APPROVED BY THE PROPERTY OWNER IN CERTAIN CIRCUM-
STANCES.
WHEREAS, various state and municipal agencies from
time to time acquire property by eminent domain proceedures
or negotiations which property is subject to outstanding
local improvement district assessments in which an apportion-
ment of an assessment between the acquiring agency and the
affected property owner would be unduly burdensome, now,
therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. The Local Improvement Code of the City of
Edmonds is hereby amended by the addition thereto of a new
section reading as follows:
"Section 7.04.140 Reductions in area of assessments.
The office of the City Treasurer may accept a reduc-
tion in the area of property subject to an assessment
for a local improvement district and apply the balance
of the assessment, including interest and penalties, if
any, to the remainder of said property subject to said
assessment, provided, that the written consent of the
property owner is filed with the City Treasurer, and
provided further that the reduction in area will not
result in a substantial diminution of the value of the
affected property remaining and subject to assessment."
