Ordinance 1394aORDINANCE NO. -' AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON REQUIRING A PERMIT, PRESCRIBING CONDITIONS FOR THE ISSUANCE THEREOF, AND REGULATING THE LAYING OF VARIOUS UTILITY LINES OR CONDUITS BY, ALONG OR ACROSS CITY RIGHT-OF-WAYS, REQUIRING FEES AND IN- SPECTIONS, AND PROVIDING PENALTIES. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 7.30.010 Permits A permit is required by the City of Edmonds for any excavation, construction, or other invasion of city right-of-way by private individuals, contractors, corporations, municipal corporations, special districts and any and all other persons or organizations. Section 7.30.020 Application Applications for such permit with City right-of-way shall be filed with the City Engineer. A plan and profile as required by the City Engineer, delineating proposed construction, existing improvements, and proposed method of final site restoration shall accompany the application. Section 7.30.030 Security Deposit Upon approval of the plan and profile by the City Engineer, the applicant shall be required to post with the City an indemnity bond or cash deposit in the amount of 150 percent of the restoration cost of the project. The amount of the bond or deposit shall be determined by the cost incurred in back -filling, compaction, restoration of cuts in -pavement, adjustment of surface appur- tenances and otherwise completely restoring all invasions of City right-of-way to their original condition. Section 7.30.040 Filing Fee Fees for permits of said construction, excavations, or other invasions within City right-of-way shall be based on the location and lineal feet of said construction as delineated on the plan and profile and shall be payable to the City prior to issuance of said permit. A $5 filing fee shall be assessed at the time of application. Section 7.30®050 Street Fee An additional fee for construction or excavation on fully improved sheets from back of walk to back of walk and on the paved surface of partially improved sheets of $7.50 for the fust 100 feet and $2 for each additional 100 feet or portion thereof shall be assessed® Section 7830®060 Right-of-way Fee An additional fee for construction or excavation with City right-of-way but beyond limits of streets as described in Section 7®30.050 above shall be assessed at 5 for the first 100 feet and 1 for each additional 100 feet or portion thereof. Section 7®30,070 Exceptions Said fees required by Sections 7.30®050 - .060 shall not apply to parties dedicating right-of-way the City by means of recorded plats® Section 7.30.080 Disruption Fee when an underground utility installation is made within five years afterimprove- ment of a street to city standards, a disruption fee in addition to the fees prescribed In Sections 7.30®050 - ,060 shall apply. This additional disruption fee shall be five times the regular construction fee if the installation is made during the first year after the street improvement is completed, four times during the second yar, three times during the third year, two times during the fourth year, and equal to the con- struction fee during the fifth year, provided, however, the City Engineer shall notify and coordinate City franchised companies, other utility companies and such other special districts and municipal corporations as may be subjected to said disruption fee as soon as practical following the final decision of the City to so improve a streets M Section 7.30®00 inspection The City shall exercise full right of inspection of all excavating, construction, and other invasions of city right-of-way. The City Engineer shall be notified 48 hours prior to commencing constructions He may issue immediate stop orders in the event of non-com- pliance with this ordinance and/or permits thereunder. Section 7®30®100 Open Cuts No open -cut crossings of City streets shall be made without the approval of the City Engineer® However, in the event they are approved, all open-euts of City streets shall be as follows: a® Existing surface to be precut two -foot wider than top of trench width. b. Back filling and mechanical compaction to 95 percent of maximum density to be accomplished in a maximum of one -foot lifts immediately after installation of pipes Cs Back -fill material shall be completely granular and free draining, excavated material may be used for back filling with the approval of the City Engineer. d, Immediately following compaction, a 4 -inch lift of compacted 1 1/4" minus crushed rock, and 3" of cold mix asphaltic concrete shall be placed® ea Final restoration of open -cut shall be accomplished prior to final cleanup as follows: Remove temporary cold patch. Edges of existing road surface to cut and trimmed to a neat line, tacked and a three-inch minimum compacted thick- ness of Class B asphaltic concrete installed in a manner satisfactory to the City Engineer® Section 7.30.110 Shoulders Shoulders disturbed by excavation shall be reshaped to the satisfaction of the City Engineer, and followed with a min® two-inch compacted crushed rock top course. Section 7.30.120 Back -fill Within Roadway. All back -fill of trenches within the improved roadway shall be compacted by mechanical means to the minimum density of 95 percent. Upon request the contractor shall at his expense furnish the City Engineer as many compaction tests as he may deem necessary for proof of minimum compaction. Compaction of water settling or wheel rolling shall be permitted only with the consent of the City Engineer. Section 7.30.130 Back -fill Within Utility Strip Back filling and restoration of trenches authorized within one utility strip on fully improved streets shall be accomplished as follows a. Back filling shall be in accordance with paragraphs "b" and "c" Section 7.30.100. b. Areas shown on the drawing or as required by the City Engineer to receive seeding or sodding shall receive topsoil. Areas to be seeded shall receive 4 inches of topsoil, areas to be sodded shall receive 3 inches of topsoil. Section 7.30®140 Drainage Existing drainage ditches, culverts, etc. shall be kept clean at all times, Temporary diversion of any drainage system shall not be permitted without the consent of the City Engineer. Any drainage culverts, catch basins, manholes, etc., disturbed by excavation shall be replaced with new material, or repaired as directed by the City Engineer. Section 7.30.150 Unsafe Travel Conditions If, in the opinion of the City Engineer it appears that the traveled M roadway is, or may become unsafe for the traveling public due to weather or other reasons, excavation shall cease immediately and clean-up shall be promptly accomplished® Section 7=30®160 open -Trench Lengths Maximum lengths of open -trench on streets shall be 200 lineal feet, except for encased conduit systems which will be coordinated on a project basis by the installer and the City Engineer. Section 7.30.170 Pipe Storage All pipe strung along City right-of-way shall be placed at a safe distance from traveled roadway in such a manner as to avoid accidental rolling onto roadway. Section 7.30.180 Cleanup Distances Final cleanup, cluing complete restoration of shoulders, cleaning of ditches, culverts and catch basins, removal of loose material from back -slope of ditches, shall not exceed 1500 lineal feet, behind excavating operations. Section 7430,190 Sealcoats If, in the opinion of the City Engineer, the final restoration of open cuts are inadequate to protect the base of the street from erosion caused by seepage of water, the contractor shall be required to sealcoat the full width of the street a distance to be determined by the City Engineer® Section 7®30.200 Daily Cleanup Street surface shall be cleaned at the end of each day's operation with a power broom or other approved means® Section 7®30.210 Excess Material No excess material or unsuitable material shall be wasted on City right-of-way without expressed consent of the City Engineer. Section 7.30.220 Signs Traffic control devices shall be in accordance with regulations established by the Washington State Department of Safety, Department of Motor Vehicles and the City„ Adequate warning suns and lights shall be provided. Section 7.30.230 Adequate materials All materials shall be readily available to the job site and provisions shall be de to complete the construction in one continuous operation® Failure to comply shall result in excavation being halted til such time as the conditions are corrected. Section 7.30.240 Barricading or Closing Streets The City Police and Fire Chiefs shall be notified 24 hours prior to barricading or closing of streets. Proper provisions shall be made for the public convenience, safety and travel. Section 7®30.250 Unattended Excavations All unattended excavations shall be properly barricaded as to prevent accidents. Section 7.30.260 Inspection and Approval The permittee shall not close any excavations nor make use of constructed utilities until inspection and approval of the entire con- struction site have been made. Section 7.30®270 Final Inspection Firor to final approval of construction, a visual inspection of the job site will be made by the City Engineer® Restoration of the area shall be complete with all improvements being restored to substantially their original condition„ Final approval of construction shall not be given earlier than 30 days after completion of construction® Section 7®30.280 Maintenance Bond If, in the opinion of the City Engineer, a maintenance bond is necessary, final approval shall not be granted until a bond in the amount of 15 percent of the original indemnity bond is posted with the City, said maintenance bond to be held by the City for a period of one year from the date of final approval. M Section 7.30.290.
