Ordinance 1714ORDINANCE NO. 1714 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE BUILDING CODE FOR SAID CITY BY THE ADOPTION OF THE 1973 EDITION OF THE UNIFORM BUILDING CODE, (EXCLUDING CHAPTER 51 OF THE APPENDIX) AND THAT CERTAIN VOLUME ENTITLED "UNIFORM BUILDING CODE STANDARDS," 1973 EDITION, AND ELIMINATING PLAN CHECK FEES FOR SINGLE FAMILY RESIDENCES, ESTABLISHING PERMIT FEES FOR FENCES, HOUSING COMPLIANCE INSPEC- TIONS AND RELOCATION OF BUILDINGS; REQUIRING PROVISION FOR DRAINAGE AND GRADING BY AMENDING CHAPTER 11.02 OF THE EDMONDS CODE. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds City Code, Section 11.02.010 is hereby amended to read as follows: 11.02.010 Uniform Building Code Adopted by Reference. That certain printed code, three copies of which are and have been on file in the office of the city clerk, for the use and examination of the public, being marked, printed and designated as the Uniform Building Code, 1973 Edition, (specifically including all appendices except the appendix to chapter no. 51) and that volume entitled Uniform Building Code Standards, 1973 Edition, all copyrighted 1973 by the International Conference of Building Officials, is hereby adopted by reference and incorporated herein as if fully set forth within this chapter, as the Building Code of the City of Edmonds, subject to the modifications and amendments hereinafter set forth and the code, as adopted, shall regulate the erection, construction, enlarge- ment, alteration, repair, moving, removal, conversion, demolition occupancy, equipment, use, height, area and maintenance of buildings or structures in the city; and further provides for the issuance of permits and collection of fees therefor providing penalties for the violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of the Uniform Building Code herein mentioned and as amended and on file in the office of the city clerk is hereby established, pursuant to the Laws of the State of Washington as the Building Code in and for said city. Section 2. Section 11.02.025 (d) Expiration. is hereby amended to read as follows: "11.02.025 (d) Expiration. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void, if the building or work authorized by such permit is not commenced within 120 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one hundred twenty days. Before such work can be recommenced a new permit shall be first obtained so to do, and the fee therefor shall be one-half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided, further, that such suspension or abandonment has not exceeded one year. Section 3. There is hereby added to Chapter 11.02, a new section 11.02.030 to read as follows: 11.02.030 Drainage and Grading Requirements for Building Lots and Subdivisions: (a) Gutters, drain lines and inlets or other necessary drainage structures shall be installed where storm water dis- posal cannot be obtained without their use or where erosion cannot be prevented by finished grading and planting. Drywells shall be installed only in areas having open, well drained porous soils. Design, construction and installation of drainage structures shall be in accordance with standard engineering practice and suitable for the use and maintenance contemplated. (b) Building or owner shall provide grading to insure: (1) Diversion of water away from buildings; (2) Prevention of standing water and soil saturation detrimental to structures and lot use; (3) Provision for disposal of water from lot; (4) Protection of adjoining property. Section 4. Section 11.02.060 of the Edmonds City Code is hereby amended to read as follows: "11.02.060 Repealer Provision. That any and all ordinances in conflict with Chapter 11.02 of the Edmonds City Code are hereby repealed, provided, however, whenever provisions of this chapter and the Uniform Building Code, 1973 Edition, adopted herein, conflict with the provisions of the Edmonds Zoning Code contained in Title 12 of the Edmonds City Code, the provisions of the Zoning Code shall -control." Section 5. Section 11.02.060 of the Edmonds City Code is hereby amended to read as follows: "11.02.061 Guardrails --Section 1716 of Uniform Building Code. Section 1716 of the Uniform Building Code as adopted by reference in this chapter is amended and set forth as follows: All unenclosed floor,and roof openings; open and glazed sides of landings and stairs; balconies or porches which are more than 30 inches above grade; and roofs used for other than service of the building shall be protected by a guardrail. Guardrails shall be not less than 42 inches in height, provided however, guardrails not over 10 feet above the adjacent finished grade may be 36 inches high. Open guardrails and stair railings -2- shall have intermediate rails or an ornamental pattern such that no object nine (9) inches in diameter can pass through. Stair railings shall be not less than 30 inches above the nosing of the treads." Section 6. A new section 11.02.066 is hereby added to the Edmonds City Code to read as follows: "11.02.066 Fees --Elimination of Plan Check Fees for Single Fami of this ordinance is hereby amended for Group I and J occupancies. mit Fees.
