Ordinance 1981ORDINANCE NO. 1981 AN ORT)I��ANCE OF THE CITY OF EDMONDS, WASHINGTON, CREA'T'ING A NEW CHAPTER IN THE EDMONDS CITY CODE, CHAPTER 1.02, "POSTING AND PUBLICATION OF ORDINANCES AND NOTICES", PROVIDING FOR THE POSTING OF ORDINANCES, REPEALING A DESIGNATED OFFICIAL NEWSPAPER, AND PROVIDING FOR PUBLICATION OF OTHER NOTICES. Section 1. There is hereby created a new chapter in the Edmonds City Code, pursuant to RCW 35A.12.160 and 35A.65.020, entitled "Posting and Publication of Ordinances and Notices" which is hereby designated Chapter No. 1.02, which chapter shall consist of the following new sections. Section 1.02.010 Posting of Ordinances. The City Council finds there is no newspaper printed and published within the City of Edmonds and the City Council elects not to designate an offical newspaper. "Publication" of ordin- ances of the City of Edmonds will be made by printing and posting the ordinance(s) in the following three public places, all of which are hereby designated as the offical posting places for city notices: (1) the public bulletin board in the Edmonds Civic Center, 250 - 5th Avenue North, Edmonds, Washington 98020, (2) public bulletin board in the Edmonds Public Library, Civic Center, 250 - 5th Avenue North, Edmonds, Washington 98020; and, (3) public bulletin board, Edmonds branch of United States Post Office, 201 Main Street, Edmonds, Washington 98020. Section 1.02.020. Effective Date of Ordinances. The effective date of ordinances posted pursuant to Section 1.02.010 shall be five days after the date of its posting, unless otherwise provided by statute, except that an ordinance passed by a majority plus one of the whole membership of the City Council, designated therein as a public emergency ordinance necessary for the protection of the public health, public safety, public property, or the public peace, may be made effective upon adoption, but such ordinance may not levy taxes, grant, renew, or extend a franchise, or authorize the borrowing of money. Section 1.02.030 Affidavit of Posting. The City Clerk shall cause the posting of all ordinances required to be posted under Section 1.02.010 and shall cause to be prepared an affidavit of posting, which shall recite the date of posting in said three public places so designated. The affidavit of posting shall be attached to the ordinance, and filed for record in the official ordinance book. The date of posting the ordinance shall be set forth at the foot of the ordinance following the indicated date of passage by the City Council. Section 1.02.040 Publication of Other Notices generally. Except as provided in Section 1.02.050 below, the publication of legal notices, other than ordinances, required by law, or by ordinance of the City of Edmonds, shall be in a newspaper of general circulation within the City of Edmonds having the qualifications of a legal newspaper prescribed by state law. The City Council hereby reserves the right to designate different newspapers (meeting the preceding criteria) for particular purposes which the City Council may find from time to time to be most advantageous to the public interest for the particular notice. -2- Section 1.02.050 Publication of Specified Notices. (1) Where required to be published in a newspaper, the following notices and resolutions (including resolutions of intention), but excluding ordinances, will be published in the Western Sun which is a legal newspaper under applicable state law and has a general circulation within the City of Edmonds; those required: (a) under local improvement district laws, including the LID bonds; (b) in preparation of the annual City budget; (c) under annexation laws; and, (d) pursuant to Title 12 (Zoning, Platting & Subdivision) of the Edmonds City Code and applicable state law. In the event the City Council does not specify a particular newspaper for a specific publication pursuant to Section 1.02.040 above, newspaper publications required under general law and/or City ordinance will be in the Western Sun. Section 1.02.060 Prior References to Official Newspaper. Any and all references that might appear in other City ordinances or other sections of the Edmonds City Code, which may refer to a publication of notice or resolution in the offical newspaper, official gazette, or other such reference to a newspaper designated by the City of Edmonds as tantamount to an official newspaper are hereby superseded by this chapter of the Edmonds City Code. Such references to publi- cation of notice or resolution in an official newspaper, gazette, or other such terminology hereby superseded shall be governed hererafter by the above Section 1.02.040 and 1.02.050. -3- Section 1.02.070. Effective Date. The effective date of this chapter shall be five days after its publication, to wit, March 20, 1978. Ordinances passed subsequent to March 20,1978, shall be posted pursuant to the above Section 1.02.010; and other notices and resolutions shall be governed by the provisions of above Sections 1.02.040 and 1.02.050.
