Ordinance 2003ORDINANCE NO. 2003 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING, ADDING TO, AND REPEALING PORTIONS OF CHAPTER 1.26 OF THE EDMONDS CITY CODE, DELINEATING THE POWERS AND DUTIES OF THE POLICE DEPARTMENT AND FIRE DEPARTMENT CIVIL SERVICE COMMISSIONS. WHEREAS, the effective and efficient functioning of the City of Edmonds, Civil Service Commissions will be facilitated by updating the powers of the commissions, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Edmonds City Code Sections 1.26.020, 1.26.030, and 1.26.050 are hereby repealed. Section 2. Edmonds City Code Section 1.26.040 is hereby recodified as Section 1.26.020. Section 3. There is hereby added to Chapter 1.26 of the Edmonds City Code a new Section 1.26.030 which shall read as follows: Section 1.26.030 Powers and Duties. The Police and Fire Department Civil Service Commissions shall have the following powers and duties: (a) Except as hereinafter specifically provided in subsection (b) the provisions of Revised Code of Washington Chapter 41.08 and 41.12, three copies of which are on file in the office of the Clerk of the City of Edmonds, shall control the powers and duties of the commissions. (b) Notwithstanding any provision in Revised Code of Washington Chapters 41.08 and 41.12 to the contrary, the Police Department and Fire Department Civil Service Commissions shall have the following powers: (1) Whenever requisition is made upon the commission for the names of persons eligible for appointment to any vacancy, including both original appointment and promotions, the commission shall have the power to provide by regulation for the certification to the Mayor of the names of the top three persons on such eligibility list for each vacancy. The Mayor shall fill the vacancy from the persons so certified. (2) The Civil Service Commission shall have the power to establish the length of time policemen or firemen must serve on a probationary status and shall establish the length of probationary status by regulation; provided that in no event shall the probationary period exceed one year. (3) Temporary or provisional appointments may continue for, but shall not exceed, six months. No persons shall receive more than one temporary or provisional appointment or serve more than six months as either a temporary or provisional appointee in any one fiscal year. In addition, the Mayor shall have the power in emergencies to appoint employees to fill vacant promotional positions in an acting capacity for the duration of the emergency. Such appointments shall be de- nominated "acting appointments" and shall not be included in determining the permissible number of, or period for, temporary or provisional appointments. (4) To provide for joint Civil Service Examinations and Eligibility Lists with other cities and to recognize for the purposes of reemployment the employee layoffs of other cities using the joint test. -2- Section 4.
