Ordinance 2011ORDINANCE NO. _2011 - AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON PROVIDING FOR THE ACQUISITION OF CERTAIN PARCELS OF PROPERTY WITHIN SAID CITY FOR PUBLIC PARK FACILITIES; DECLARING THE NECESSITY THEREFOR; PROVIDING FOR PAYMENT THEREOF; AUTHORIZING THE CITY ATTORNEY TO INITIATE PROCEEDINGS FOR CON- DEMNING, APPROPRIATING, TAKING, AND DAMAGING LANDS OR OTHER PROPERTIES NECESSARY THEREOF. THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Edmonds hereby finds and declares it necessary and that the public health, general welfare and convenience require that the following real property and improvements thereon, all located within the City of Edmonds, be and the same are hereby authorized to be condemned, appropriated, taken and/or damaged for public park facilities. The legal description of the property hereby authorized to be condemned, appropriated, taken and/or damaged is situated in the City of Edmonds, Snohomish County, Washington, as follows: All of Block 88, and Lots 13 to 28, inclusive, Block 97, City of Edmonds, according to plat thereof recorded in Volume 2 of Plats, page 39, records of Snohomish County, Washington. Section 2. All land, rights, privileges and other property rights within the limits of the lots, blocks and tracts of land described hereinabove are hereby condemned, appropriated, taken and damaged for public use and necessity for the purpose of public park facilities. All such land, rights, privileges and other property rights are to be taken, damaged and appropriated only after just compensation has been made or paid into Court for the owners thereof in the manner provided by law applicable to Code Cities. Section 3. The entire cost of the improvements provided for herein shall be paid by the City of Edmonds from General Funds applicable thereto. Section 4. The City Attorney is hereby authorized and directed to begin and prosecute the proceedings provided by law to condemn, take, appropriate and/or damage the land, rights, privileges and other property rights necessary to carry out the provisions of this Ordinance, and is further authorized in conducting said proceedings for the purpose of minimizing damages, to enter unilateral stipulations as to the use of the property herein authorized to be condemned and to stipulate to the reservation of any right of use to any owner, provided that such reservation does not interfere with the use of said property by the City as provided by this Ordinance. -2- Section 5.
