AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 5.02.020'OF THE EDMONDS CITY CODE
TO AUTHORIZE THE MUNICIPAL COURT TO SET AN INCREASED
BAIL FOR PERSONS WHO FAIL TO APPEAR BEFORE THE
COURT.
WHEREAS, there are presently a substantial number
of persons who have been cited for violations of the Edmonds
City Code who have failed to appear in court in answer to a
citation and notice to appear after having given their
written promise to appear, and
WHEREAS, such persons by failing to appear as
promised have demonstrated that the bail previously set will
not assure their appearance, and causes an increased administrative
burden resulting in a need for additional penalties to help
reduce the number of those failing to appear, and
WHEREAS, the City Council of the City of Edmonds,
finds that the following ordinance is in the best interest
of the orderly administration of justice, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 5.02.020 of the Edmonds City
Code is hereby amended to read as follows:
"5.02.020 Establishing bail. The municipal court
shall designate the specified offenses under
ordinances of this city in respect to which payment
of bail may be accepted by the violations bureau
in satisfaction thereof, and may specify by suitable
schedules the amount of such bails for first,
second and subsequent offenses, provided such
bails are within the limits declared by law or
ordinances, and may further specify what number of
such offenses shall require appearance before the
court. The municipal court may also specify by
suitable schedule the bail for persons who have
failed to appear before the court as required by
statute, ordinance or applicable court rule.
Section 2. This ordinance shall be in full force
and effect 5 days after passage and publication by posting
as provided by law.
