Ordinance 2033ORDINANCE NO. 2033 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADDING A NEW CHAPTER 1.05 TO THE EDMONDS CITY CODE REQUIRING A CERTAIN MINIMUM ATTENDANCE FOR MEMBERS OF CITY BOARDS, COMMISSIONS AND COMMITTEES, AND PROVIDING FOR AUTOMATIC REMOVAL THEREFROM. WHEREAS, regular attendance is essential to the proper performance of City boards, commissions and committees, and WHEREAS, the following new provisions will insure that the City boards, commissions and committees will better serve the public and the City of Edmonds, and will thus be in the best interests of the public health, safety and general welfare, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new Chapter 1.05 is hereby added to the Edmonds City Code to be entitled "Public Meetings Attendance." Section 2. A new Section 1.05.010 is hereby added to the Edmonds City Code to read as follows: 1.05.010. Attendance Required_. In addition to being subject to removal for other particularized grounds as set forth in applicable provisions of the Edmonds City Code, members of all City boards, commissions and committees (hereinafter "Members") except as set forth herein, shall be removed from office, and the position deemed vacant as set forth in Section 1.05.020(3) if such Member attends less than seventy per cent (70%) of the regular etings in any one (1) calendar year, and/or is not in attendance at three (3) or more consecutive regular and/or special meetings. Attendance may not be excused for this purpose. Section 3. A new Section 1.05.020 is hereby added to the Edmonds City Code to read as follows: 1.05.020 Attendance Records. 1) The City Clerk shall keep a record of attendance of all board, commission and committee meetings. Upon any Member failing to attend three or more consecutive (eW regular -- I meetings, the City Clerk shall certify said Member's name in writing to the Mayor and shall notify in writing the Members, the Chairperson, and the appropriate City department head. 2) On or before January 15 of each calendar year, com- mencing in 1980, the City Clerk shall compile a list of Members, if any, who have attended less than 70% of the regular axed-p meetings in the past calendar year, and shall certify this list to the Mayor. The City Clerk shall also notify in writing the Members, the applicable Chairperson and the appropriate City depart- ment head. 3) The Member shall be automatically removed from office and the position deemed vacant as of the date of the City Clerk's written notification as set forth in sub section (1) and (2) above. Section 4. A new Section 1.05.030 is hereby added to the Edmonds City Code to read as follows: 1.05.030 New Nominees_Appointment/Confirmations. Upon receipt from the City Clerk of the names of Members failing to maintain attendance as provided herein, the Mayor shall, within 90 days thereof, submit new nominations to the City Council for confirmation. The City Council shall confirm or reject the nominations within 30 days after the Mayor submits the nominations to the Council for consideration. A Member removed for failing to maintain attendance as provided by this chapter may not be renominated or reappointed to a position on that or other City of Edmonds' board, committee or commission for at least one year after removal. Section 5. A new Section 1.05.040 is hereby added to the Edmonds City Code to read as follows: 1.05.040. Exemptions. The provisions of this chapter shall not apply to Members of the following boards, commissions and committees: (1) Edmonds City Council (2) Edmonds Civil Service Commission Section 6. A new section 1.05.050 is hereby added to the Edmonds City Code to read as follows: 1.05.050 Quorum Requirements. Notwithstanding any other provision of the Edmonds City Code, if the number of Members of any City board, com- mission or committee having seven positions and subject to this chapter, should be reduced to six or less for any reason, including a member's removal for failure to maintain attendance, three members shall constitute a quorum. Section 7. Applicability. The attendance requirements set forth in this ordinance shall apply to all meetings held after January 1, 1979. Section 8. Effective Date. This ordinance shall be in full force and effect five (5) days after passage and publica- tion by posting as provided by law. APPROVED: MAYOR, H. H.
