AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 12.15.100 OF THE EDMONDS CITY
CODE REGULATING THE RESTORATION OF DAMAGED BUILDINGS
AND STRUCTURES.
WHEREAS, the Edmonds Planning Commission has held
a public hearing regarding the following amendment to the
Edmonds Zoning Code and has forwarded its recommendations to
the City Council in Resolution No. 610, and
WHEREAS, the City Council, after public hearing,
has determined that the following amendment is in the best
interest of the public health, safety and general welfare
and having determined that there will be no significant
adverse environmental impacts, now, therefore,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. Section 12.15.100 of the Edmonds City
Code is hereby amended to read as follows:
"12.15.100. Restoration of Damaged Non -Conforming Buildings.
1. Whenever a structure which is primarily non-
residential is damaged in excess of fifty percent
of its valuation as determined in this Chapter,
the use and repair of the structure shall be
treated as a new building and shall conform to all
the regulations of the district in which it is
located.
2. Whenever a building which is primarily residential
is damaged to any extent, the non -conforming
residential use may continue if reconstruction is
started within one year of the date the damage
occurred.

3. A non -conforming primarily residential
building, which has been damaged to any extent
may be restored in the same location, to the
same height, bulk, density and dimensions
as the building before the damage occurred if
the reconstruction is started within one year
of the date the damage occurred.
4. Any additional construction on the site
shall comply with the regulations of the district
and shall not increase the non -conformity of the
building or use.
Section 2. This ordinance shall be in full force
and effect five (5) days after passage and publication by
posting as provided by law.
