ORDINANCE NO. 2813
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
DIRECTING THE CODE CODIFIER TO CORRECT SECTION
8.05.030 RELATING TO STATUTES NOT ADOPTED AND
AMENDING SAID SECTION TO DELETE REFERENCES TO
RCW 46.61.515(1) AND (2), AND FIXING A TIME WHEN
THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, ordinance number 2187, section 2, as adopted
in 1980 indicates that RCW 4 6. 61.515 (1) and ( 2 ) were not adopted
as a part of the Edmonds City Code; and
WHEREAS, ordinance 2507, section 1, adopted in 1985,
amended section 8.05.010 to adopt RCW 46.61.515 in full by
reference but failed to provide for the deletion of the sections
of section 8.05.030 relating to 46.61.515(1) and (2);
WHEREAS, the Council finds that the contrary provisions
of section 8.05.030 relating to RCW 46.61.515(1) and (2) are and
have been repealed by implication and under the authority granted
by RCW 35A.21.010, 35A.21.130 and 35A.21.500 may be deleted by
the code codifier without necessity for repeal but wish to
clarify that RCW 46.61.515 has been adopted in full by the city
of Edmonds; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds City Code section 8.05.030
STATUTES NOT ADOPTED has previously been amended to delete
references to RCW 46.61.515(1) and (2) and shall read as follows:

The following sections in the RCW which were
adopted by reference in the MTO are not
adopted by this reference and are expressly
deleted.

Section 2. The code codifier is hereby directed to
immediately delete references to RCW 46.61.515(1) and RCW
46.61.515(2) as contained in section 8.05.030 of the Edmonds City
Code. This direction is made in recognition and exercise of the
powers granted to the City by RCW 35A.21.010, 35A.21.130 and
35A.21.500. It is the belief of the City Council that these code
sections provide adequate authority to delete the improper
reference and that actual repeal of the inconsistent provisions
of section 8.05.030 is not legally required. However, this
ordinance has been adopted for the purpose of clarity.
Section 3. The City Council hereby declares that an
emergency exists necessitating that this ordinance take effect
immediately upon passage by unanimous vote of the members of the
City Council.
