Ordinance 28240006. WSS/tcp/klt 11/3 0/90 2824 ORDINANCE NO. AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE ENVIRONMENTALLY SENSITIVE AREAS MAP AND EDMONDS POLICY PLAN TO INCLUDE THE COLLEGE PLACE TRAFFIC AREA AND FIXING A TIME WHEN SUCH ACTION SHALL BE EFFECTIVE. WHEREAS, the City has designated through the Edmonds Policy Plan certain environmentally sensitive areas which are not subject to the exemptions established by WAC 197-11-800 and ECDC 20.15A.100; WHEREAS, the Council finds that the traffic within the College Place area has reached a critical level and has previously commissioned a study know as the Bell Walker Report in order to determine the offsite impacts of development and appropriately assess mitigation fees; WHEREAS, the implementation of mitigation fees are restricted by the categorical exemption relating to the construction of building projects with four or fewer units; and WHEREAS, the Council finds that the College Place neighborhood, given the impacts of any additional impact traffic on the already critical traffic situation, should be designated as an environmentally sensitive area in order that all new construction be reviewed to determine whether impact fees are appropriate, NOW, THEREFORE, - THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO IQ007VI�WX1 4a"0 0col AAl A WSS52872O -1- Section 1. The Edmonds Policy Plan, the Environmentally Sensitive Areas Map is hereby amended to include the College Place traffic area shown on the Attached Exhibit A, incorporated by this reference as fully as if herein set forth. Section 2. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of the ordinance or a summary thereof consisting of the title.
