Ordinance 28290006.150.015 WSS/klt 02/21/91 ORDINANCE NO. 2229 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 20.15A.290 FEES, SUBSECTION (A) THRESHOLD DETERMINATION, OF THE EDMONDS COMMUNITY DEVELOPMENT CODE TO CLARIFY THE FEE WAIVER PROVISION FOR SEPA THRESHOLD DETERMINA- TIONS AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, subsection 20.15A.290(A) FEES, Threshold determination, of the Edmonds Community Development Code should be modified to clarify the applicability of the fee waiver provision for threshold determinations; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 20.15A.290(A) FEES, Threshold determination, of the Edmonds Community Development Code is hereby amended to read as follows: 20.15A.290 FEES A. Threshold determination. For every environmental checklist the City reviews as lead agency, the City shall collect a fee set by Chapter 15 from the proponent of the proposal prior to undertaking the threshold deter- mination. This fee may be waived as provided therein. The time periods provided by this chapter from making a threshold determination shall not begin to run until fee has been paid or waived in writing by the responsible official. When the City assists the applicant or completes the environmental checklist at the applicant's request under section 20.15A.120(E) of this chapter, an additional fee equal to the estimated WSS531120 -1- actual cost of providing the assistance shall be collected. Section 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of the ordinance or a summary thereof consisting of the title.
