Ordinance 28460006.160.010 JGR/naa 08/01/91 ORDINANCE NO. 2846 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING EDMONDS CITY CODE BY DELETING SECTION 8.32.010 AND ADDING SECTION 5.46.050 TO RESTRICT THE USE OF SKATEBOARDS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Edmonds is a noncharter code city organized and existing under the provisions of Title 35A of the Revised Code of Washington, and WHEREAS, the City Council formerly enacted an ordinance restricting skateboarding which was codified at section 8.32.020, and WHEREAS, the City Council has determined that the ordinance would be more appropriately codified at section 5.46.050 as a miscellaneous crime, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 8.32 Miscellaneous Driving and Traffic Rules is hereby amended by deleting section 8.32.020 from the Chapter. Section 2. Chapter 5.46 Miscellaneous Crimes is hereby amended by adding a new section 5.46.050, to read as follows: 5.46.050 USE OF SKATEBOARDS ROLLER SKATES AND SIMILAR DEVICES RESTRICTED A. It is unlawful for any person to operate a skateboard, coaster or similar device upon JGR006100 -1- any of the following areas: 1. all streets; and/or 2. all sidewalks in the area bounded by Main Street to Dayton Street, from 6th Avenue South to Railroad Avenue, and 5th Avenue from Bell Street to Maple Street. B. It is unlawful for any person to rollerskate or operate a toy vehicle or similar device upon any street of the City. C. For the purpose of this section, a street is defined to include those areas described in section 8.04.015, provided that a "street" shall not encompass a sidewalk. Section 3. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of the ordinance or a summary thereof consisting of the title.
