ORDINANCE NO. 2918
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF SECTION
5.32.107 REGARDING ADOPTION OF STATE
REGULATIONS REGARDING THE TAKING AND
POSSESSION OF SHELLFISH TO INCLUDE WAC 220 -56-
312, RENUMBERING CERTAIN OTHER PROVISIONS AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the City has previously adopted Ordinance No.
2911 in order to incorporate state regulations regarding the taking
and possession of shellfish, and
WHEREAS, in order to better administer this provision,
the subparagraphs need to be numbered in order to establish an
appropriate bail schedule, and
WHEREAS, the City wishes to adopt the general regulation
of WAC 220 -56 -312 regarding shellfish, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 16 Section 5.32.107 of the Edmonds City Code is
hereby amended to read as follows:
Section 5.32.107. STATE REGULATIONS ON TAKING
AND POSSESSION OF SHELLFISH - ADOPTION BY
REFERENCE. The following sections of the
Washington Administrative Code (WAC) and the
Revised Code of Washington (RCW) regulating
the taking of and possession of shellfish are
hereby adopted by this reference as fully as
if herein set forth:

Section 2. Severability. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 3. Effective Date. The City Council hereby
declares that an emergency exists necessitating that this ordinance
take effect immediately upon passage by no fewer than four (4)
affirmative votes of the members of the City Council.
