ORDINANCE NO. 2943
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING TITLE 5 OF THE EDMONDS
CITY CODE AND FIXING A TIME WHEN THE SAME
SHALL BECOME EFFECTIVE.
WHEREAS, the State of Washington and its legislature have
required that cities, code cities and towns may not establish
penalties for an act which constitutes a crime that is different
from the penalty prescribed for that crime by state statute; and
WHEREAS, this ordinance is in the interests of public
health, safety and welfare NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. IMPERSONATION OF A LAW ENFORCEMENT OFFICER,
Section 5.40 of the Edmonds City Code is hereby amended to include
the following new section:
5.40.060 Impersonation of a Law Enforcement
Officer
A. A person is guilty of criminal
impersonation in the second degree if the
person (i) claims to be a law enforcement
officer or creates an impression that he
or she is a law enforcement officer; and
(ii) under circumstances not amounting to
criminal impersonation in the first
degree, does an act with intent to convey
the impression that he or she is acting
in an official capacity and a reasonable
person would believe the person is a law
enforcement officer.

B. Criminal impersonation in the second
degree is a misdemeanor as defined in ECC
5.50.020.
Section 2. Severability. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 3. Effective Date. This ordinance, being an
administrative action, is not subject to referendum and shall take
effect five (5) days after publication.
