ORDINANCE NO. 2945
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING SECTION 5.40 ADDING
SECTION 5.42.060 RELATING TO EXPLOSIVES AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the State of Washington and its legislature have
added criminal penalties related to explosives; and
WHEREAS, the Edmonds City Council finds that this
ordinance is in the interest of the public health, safety and
welfare; NOW THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 5.46 of the Edmonds City Code is
hereby amended by adding new section 5.46.060 as follows:
5.46.060 EXPLOSIVES.
A. No person, except the Director of Labor
and Industries or the Director's
authorized agent, the owner, the owner's
agent, or a person authorized to enter by
the owner or owner's agent, or a law
enforcement officer acting within or her
official capacity, may enter any
explosives manufacture building, magazine
or car, vehicle or other common carrier
containing explosives in the City of
Edmonds.
B. No person shall abandon explosives or
improvised devices. Improvised devices
include a device which is fabricated with
explosives or destructive, lethal,
noxious, pyrotechnic, or incendiary
chemicals and which is designed to
disfigure, destroy, distract, or harass.

C. Violation of 5.46.060 A or 5.46.060 B is
a gross misdemeanor, adopting RCW
70.74.160, RCW 70.74.295 and RCW 9A.20.
Section 2. Severability. If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
Section 3. Effective Date. This ordinance, being an
administrative action, is not subject to referendum and shall take
effect five (5) days after publication.
