Ordinance 27590006.150.018A WSS/klt 02/14/90 ORDINANCE NO. 2759 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF THE EDMONDS COMMUNITY DEVELOPMENT CODE TO PROVIDE FOR SMALL ANIMAL HOSPITALS AS A PRIMARY PERMITTED USE IN THE NEIGHBORHOOD BUSINESS (BN) ZONE, DEFINING SMALL ANIMAL HOSPITAL, AMENDING THE DEFINITION OF COMMERCIAL KENNEL, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the Planning Board and City Council have held public hearings to gather the input of the public regarding the amendment of the provisions of the neighborhood business (BN) zone to consider providing for small animal hospitals as primary permitted uses, and WHEREAS, after considering the recommendation of the Planning Board and the public testimony, the City Council finds that small animal hospitals, if properly controlled, provide a service related to neighborhood residential districts, and, as such, should be permitted in the neighborhood business zone, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds Community Development Code, Section 16.45.010 USES, subparagraph A Permitted Primary Uses is hereby amended to read as follows: 16.45.010 USES A. Permitted Primary Uses. WSS52102O -1- 5. Small Animal Hospitals. Section 2. The Edmonds Community Development Code, section 21.15.060 Commercial Kennels is hereby amended to read as follows. 21.15.060 COMMERCIAL KENNELS Commercial Kennel means a building in which four (4) or more domestic animals at least four (4) months of age are kept commercially for boarding or breeding. Section 3. The Edmonds Community Development Code, chapter 21.90 is hereby amended by the addition of a new section 21.90.095 Small Animal Hospital to read as follows: 21.90.095 SMALL ANIMAL HOSPITAL A small animal hospital means a veterinary facility which treats small domestic house pets such as dogs, cats, birds, fish and/or other small exotic animals under one hundred (100) pounds. This definition shall not include veterinary facilities which board or breed domestic animals or which treat, board or otherwise house or care for horses, sheep, cattle, pigs or other species of animals which typically weigh over one hundred (100) pounds per mature individual. Section 4. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of the ordinance or a summary thereof consisting of the title.
