Ordinance 27710006.040.014 WSS/crd 08/30/88, R:05/02/90 ORDINANCE NO. 2771 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF CHAPTER 19.20 TO ADD A NEW SECTION 19.20.010, THEREBY AMENDING THE PROVISIONS TO THE DANGEROUS BUILDING CODE TO DEFINE A DANGEROUS BUILDING AS INCLUDING A STRUCTURE CONTAMINATED WITH TOXIC CHEMICALS, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the illegal manufacture of methamphetamine poses a serious health risk to the citizens of the City of Edmonds, to public safety officers and to others; and WHEREAS, said risk is associated with such illegal activities due to the potentially toxic chemicals in the manufacturing process and because said manufacture of methamphetamine creates unstable and toxic byproducts as a part of the manufacturing process; and WHEREAS, structures in which such manufacturing process occurs may themselves become contaminated with said toxic substances such that the structure may require abatement in accordance with the provisions of the Dangerous Building Code; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 19.20 Dangerous Buildings of the Edmonds Community Development Code is hereby amended by the addition of a new section 19.20.010 to read as follows: WSS508410 -1- 19.20.010 Structures Contaminated by Toxic Substances. The Dangerous Building Code, section 302 Dangerous Building, is hereby amended by the addition of a new subparagraph 19 to read as follows: 19. Whenever a building or portion thereof is determined to be contaminated with toxic chemicals. A rebuttable presumption is hereby created that a building is contaminated with toxic chemicals if such a determination is made by the Snohomish County Health District, by the Washington State Department of Ecology, or by the U.S. Environmental Protection Aaency, in accordance with such criteria and standards as such public agencies shall establish. Section 2. The City Clerk is hereby instructed to prepare a certified copy of such ordinance and to forward the same to the Washington State Building Code Council. The City Attorney is authorized to take such steps that shall be necessary in order to obtain approval of this Code change. Section 3. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of the ordinance or a summary thereof consisting of the title, or until such time as this revisions has been approved by the Washington State Building Code Council.
