ORDINANCE NO. 2775 -A
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
AMENDING SECTION 3.20.050 TO ADD A PARAGRAPH C
IMPOSING A USE TAX IN LIEU OF AN OCCUPATIONS TAX
ON BROKERED NATURAL GAS AND FIXING A TIME WHEN
THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, the State Legislature has by SHB 1574 created
a special category for city use taxes which are to be applicable
to brokered gas transactions; and
WHEREAS, the City Council finds it would be in the
public interest to impose a use tax in order to equalize public
utility occupation taxes and brokered gas use taxes; and
WHEREAS, the imposition of such tax would be a vehicle
to return lost revenues to the city, facilitating the state's
collections of taxes rightfully due and owing to the state and to
the citizens of the City of Edmonds; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds City Code section 3.20.050
OCCUPATION SUBJECT To TAX --AMOUNTS is hereby amended by the
amendment of the title and the addition of a new subparagraph C
relating to brokered natural gas to read as follows:
3.20.050 OCCUPATION SUBJECT TO TAX ---AMOUNTS:
USE TAX IN LIEU OF BROKERED NATURAL GAS TAX
C. Brokered natural gas --ruse tax in lieu ❑f
occupations tax. There is imposed under the
authority of RCW 35.21.870 a use tax on the

consumers of brokered natural gas. Such tax
shall be in lieu of the tax imposed by
paragraph B above when consumers receive
natural gas directly from a producer of
manufactured natural gas outside of the
state of Washington. Such tax shall be the
same as that imposed on a natural
manufactured gas utility by paragraph B,
equal to 5-3/4% of the customer's monthly
purchases or other use charge by the broker
of outstate natural gas.
Section 2. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the ordinance or a summary thereof
consisting of the title.
