ORDINANCE NO. 2781
AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON,
ADDING A NEW SECTION 5.10.052 TO THE EDMONDS
CITY CODE TO ADOPT BY REFERENCE THE STATE LAW
PROHIBITING THE FAILURE TO STOP A VESSEL UPON
THE REQUEST OF A LAW ENFORCEMENT OFFICER;
CONTAINING A SEVERABILITY CLAUSE AND SETTING AN
EFFECTIVE DATE.
WHEREAS, the Edmonds City Council recognizes that the
Washington State Legislature created a new crime of failing to
stop a vessel "when requested or signaled to do so by a person
reasonably identifiable as a law enforcement officer," and
WHEREAS, the Edmonds City Council finds that the
adoption of this new law will promote water -traffic safety, NOW,
THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. There is hereby added to the Edmonds City
Code a new section 5.10.052 to read as follows:
5.10.052 Failure to stop Gressel upon re uest
of a law enforcement officer.
A. Chapter 235, Section 1, Laws of 1990,
including all future amendments thereto,
is hereby adopted by reference.
B. Violation of this section constitutes a
gross misdemeanor, punishable by a
maximum fine of $5,000.00 and one year in
jail.
Section 2. If any section, sentence, clause or phrase
of this ordinance should be held to be invalid or unconstitutional

by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
section 3. This ordinance, being an exercise of a
power specifically delegated to the City legislative body, is not
subject to referendum, and shall take effect five (5) days after
passage and publication of the ordinance or a summary thereof
consisting of the title.
