Ordinance 30370006.150.097 WSS /are 07/15/94 ORDINANCE NO. 3037 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF SECTION 20.60.080 TEMPORARY SIGNS, PARAGRAPH H CAMPAIGN SIGNS AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the Washington State Supreme Court has upheld limitations on the time, place and manner in which campaign signs may be erected in the public right of way but indicated that restrictions on the period of time prior to an election when a sign may be erected and maintained are in violation of the constitution, and WHEREAS, the City Council wishes to amend the Sign Code provisions in order to incorporate the Constitutional limitation enunciated by the court, and WHEREAS, the City Council finds that the erection of public signs in planted, landscaped right of way areas of the City could destroy the plantings in public parks or around public buildings and may be seen as implying the inappropriate sponsorship of the City for a particular campaign issue or candidate, and WHEREAS, the limitation of sign area will permit greater public use of the area without conflicting with pedestrian and vehicular traffic, and WHEREAS, the City Council finds that the maximum sign area of eight square feet will permit adequate exercise of constitutionally protected free speech rights while balancing the potential danger to pedestrian and vehicular traffic, NOW, THEREFORE, 78971.1 -1- THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds Community Development Code Section 20.60.080 TEMPORARY SIGNS, paragraph H CAMPAIGN SIGNS is hereby amended to read as follows: 20.60.080 TEMPORARY SIGNS H. Campaign Signs. Sign copies shall be limited information about a candidate, political party or public issue involved in a current election campaign. Campaign signs are permissible at the edge of the public right of way (provided they are not hazardous to pedestrian or vehicular traffic or located within landscaped areas). Such signs shall be removed within ten (10) days after the primary, general or special election to which they pertain. Campaign signs may not otherwise be placed on public property such as parks, landscaped areas within the right of way or the areas around public buildings. Maximum sign area shall be limited to eight (8) square feet. Section 2. Effective Date. This ordinance, being an administrative action, is not subject to referendum and shall take effect five (5) days after publication of an approved summary thereof consisting of the title.
