ORDINANCE NO. 3038
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE CURRENT
COMPREHENSIVE PLAN TO AMEND THE PLAN
DESIGNATION FOR CERTAIN REAL PROPERTY LOCATED
AT 23713 EDMONDS WAY FROM HIGH DENSITY
RESIDENTIAL TO COMMERCIAL BUSINESS AND TO
REZONE SAID PROPERTY FROM SINGLE FAMILY
RESIDENTIAL (RS -8) TO COMMUNITY BUSINESS (BC),
PROVIDING A DESCRIPTION OF THE PROPERTY
CONFIRMING SUCH DESIGNATION IN THE NEWLY
ADOPTED COMPREHENSIVE PLAN AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, on June 20, 1995 the Edmonds City Council ,held a consolidated
hearing regarding amendment of the City's Comprehensive Plan for File No. CDC -95 -48 from
high density residential to commercial business and to rezone the property described in File No.
R -95 -22 from RS -8 to commercial business, and
WHEREAS, the property located at 23713 Edmonds Way in the City of Edmonds,
Washington lies along Highway 99 in an area characterized by commercial growth, and
WHEREAS, the City Council finds that the staff report and the evidence
submitted indicates that the Comprehensive Plan amendment and rezone are in compliance with
the State Environmental Protection Act, the Edmonds Community Development Code and the
Edmonds Comprehensive Plan (upon its amendment), and

WHEREAS, the only evidence introduced at the hearing tended to indicate that
the criteria of the Code were met and no .contrary evidence was presented to the City Council,
the Edmonds City Council therefore finds that all the criteria established by the Edmonds
Community Development Code for amendment of its Comprehensive Plan and to rezone the real
property described herein have been met, and
WHEREAS, the City Council has contemporaneously adopted a new
Comprehensive Plan which should contain a consistent designation of commercial business,
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds Comprehensive Plan is hereby amended to designate
certain real property located at 23713 Edmonds Way, Edmonds, Washington, containing 13,500
square or .31 acres and legally described in File No. CDC -95 -48 and Exhibit A attached hereto
and incorporated herein by this reference as if set forth in full, from its current plan designation
of high density residential to commercial /business. The Community Services Director or his
designee is hereby directed and authorized to provide an amendment to the City's
Comprehensive Plan Map in effect prior to June 27, 1995, and to confirm such designation on
the City's newly adopted Comprehensive Plan in .order to so designate the property.
Section 2. The property described on the attached Exhibit A and located at 23713
Edmonds Way, Edmonds, Washington is hereby rezoned from single- family residential (RS -8)
to community business (BC).

Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
