Ordinance 30650006.150.104 PAO /are 12/12/94 R: 12/13/94 R:01 /19 /96gjz ORDINANCE NO. 3065 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, DECLARING AN EMERGENCY AND REENACTING THE EDMONDS INTERIM CRITICAL AREAS ORDINANCE, CHAPTER 20.15(B), OF THE EDMONDS COMMUNITY DEVELOPMENT CODE FOR SIX (6) MONTHS AND REQUIRING A PUBLIC HEARING WITHIN SIXTY (60) DAYS FROM THE ADOPTION OF THIS EXTENSION, AND ESTABLISHING THE EFFECTIVE DATE AS THE DATE OF ADOPTION. WHEREAS, the City of Edmonds enacted Chapter 20.15(B) of the Edmonds Community Development Code Interim Critical Areas as a part of its program of compliance with the Washington Growth Management Act, RCW Chapter 36.70A, and WHEREAS, at the date of initial enactment, the Interim Critical Areas Ordinance provided for a sunset date of July 1, 1994, and WHEREAS, Edmonds Ordinance No. 2985 extended the sunset date of the Interim Critical Areas Ordinance to January 1, 1995, and WHEREAS, on December 13, 1995 the Interim Critical Areas Ordinance was reenacted under Edmonds Ordinance 2998 as an interim ordinance with an expiration date of June 13, 1995 pursuant to the requirements of RCW 35A.63.220, and WHEREAS, the June 13, 1995 expiration date was extended to December 13, 1995 pursuant to Edmonds Ordinance 3028, and 121868.10 - I - and WHEREAS, the Interim Critical Areas Ordinance expired on December 13, 1995, WHEREAS, staff and the Planning Board have not yet submitted a recommended permanent Critical Areas Ordinance to the City Council due to other planning requirements of the Growth Management Act, Initiative 164, Regulatory Reform and other planning mandates, and WHEREAS, if the Interim Critical Areas Ordinance is not readopted immediately the City of Edmonds will have to review development projects which could pose a serious threat to the environment without critical areas protection as required by the Washington State Growth Management Act, RCW` Chapter 36.70A, and WHEREAS, RCW 35A.63.220 requires that a jurisdiction adopting an interim critical areas ordinance without a hearing shall hold the hearing within 60 days of adoption; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Reenactment. Chapter 20.15(B) Interim Critical Areas of the Edmonds Community Development Code, the expiration date of which was most recently extended to December 13, 1995 pursuant to Edmonds Ordinance 3028, is hereby reenacted and shall expire six months from the date of passage of this ordinance or the date upon which a new critical areas ordinance is enacted pursuant to the provisions of the Growth Management Act, whichever shall first occur. 121868.10 - 2 - Section 2. Public Hearing Date. A public hearing shall be held on March 5, 1996 regarding this ordinance said date being no later than 60 days after the date of adoption. Section 3. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Declaration of Emergency and Effective Date. The City Council hereby declares that based upon the findings set forth in the introductory paragraphs and legislative findings, an emergency exists necessitating that this ordinance take effect immediately upon passage by unanimous vote of the members of the City Council.
