Ordinance 30710006.160.144 DLF /srf 11/07/94 R:02/13/96dlf ORDINANCE NO. 3071 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, CREATING A NEW SECTION ADOPTING RCW 9A.44.130, AND ITS PENALTIES, AND RCW 9A.44.140, RELATING TO THE REGISTRATION OF SEX OFFENDERS AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the State legislature has found that sex offenders often pose a high risk of re- offense, and that law enforcement's efforts to protect their communities, conduct investigations and quickly apprehend offenders who commit sex offenses, are impaired by lack of information available to law enforcement agencies about convicted sex offenders who live within the law enforcement agency's jurisdiction; and WHEREAS, the legislature has required that persons convicted of a sex offense register with the county sheriff of the county in which that person resides, and has found that sex offender registration has assisted law enforcement agencies in protecting their communities; and WHEREAS, the legislature has required that the criminal penalties set by cities be the same as those set by the State, and WHEREAS, the City Council of the City of Edmonds finds that adopting the state statute by reference is in the interest of the public health, safety and welfare; NOW, THEREFORE, 65376.2 -1- THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 5.38.140 entitled "Registration of Sex Offenders--Procedures- Sex Offense Defined -- Penalties ", is hereby created and added to Edmonds City Code Chapter 5.38 to read as follows: 5.38.140 REGISTRATION OF SEX OFFENDERS- - PROCEDURES- -SEX OFFENSE DEFINED -- PENALTIES. The following sections in the Revised Code of Washington, and all other statutes adopted by reference therein, including all future amendments, are adopted by reference as if set forth in full herein: A. RCW 9A.44.130 Registration of sex offenders- - Procedures- -Sex offense defined -- Penalties. B. RCW 9A.44.140 Registration of sex offenders- - termination of duty to register. Section 2. The City Clerk is directed to authenticate, record and maintain a copy of the state statutes adopted by reference in this ordinance on file for use and examination by the public as provided by RCW 35A.12.150. Section 3. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title. 65376.2 -2- APPROVED: AYOR, BARBARA S.
