Ordinance 30730006.120.001 PAO /Ifs 2/28/96 ORDINANCE NO. 3073 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 5.05.060 OF THE EDMONDS CITY CODE, RELATING TO DOGS ON PUBLIC GROUNDS, AND NOTIFYING THE PUBLIC THAT DESIGNATED AREAS OF MAPLEWOOD PARK, PINE RIDGE PARK, SIERRA PARK, CITY PARK, MATHAY - BALLINGER PARK AND SEAVIEW PARK ARE OPEN TO DOGS, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City Council enacted Ordinance No. 3033 on June 27, 1995, in order to amend section 5.05.060 of the Edmonds City Code to permit dogs in designated parks, and WHEREAS, the intent of the City Council at the time that Ordinance No. 3033 was adopted was to incrementally open other parks for dogs, and WHEREAS, in the whereas clause of Ordinance No. 3033 the Council expressed the intent to open Maplewood Park, Pine Ridge Park, Sierra Park, City Park, Mathay - Ballinger Park and Seaview Park for dogs by January of 1996, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 5.05.060(B) of the Edmonds City Code, relating to dogs on public grounds is hereby amended to read as follows: B. Notwithstanding the restrictions set forth in Section 5.05.060(A), dogs accompanied by their owners may be walked or exercised in the following areas: PA0125478.10/FM.120.001 -1- 1. The inner trails of Yost Park in the area commonly known as the Shell Valley area; and 2. Marina Beach Park in the area south of the Union Oil loading terminal, such area being further described to be a walking strip of 50 feet in width at the entrance of and along the east end of Marina Beach Park South; and 3. The asphalted pathways in Sierra Park; and 4. The inner trails of Pine Ridge Park; and 5. All trails in Maplewood Park; and 6. The southeast wooded area of City Park; and 7. The turf area of Mathay - Ballinger Park; and 8. The asphalted pathways of Seaview Park. C. All dogs permitted in the areas designated in Section 5.05.060(B) shall be on a leash except for dogs permitted in Marina Beach Park South. Section 2. The Manager of Parks and Recreation is hereby directed to post notices at such areas as designated above that are open to owners and their dogs. Section 3. Severbility. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect PA0125478.10/F0006.120.001 -2- five (5) days after passage and publication of an approved summary thereof consisting of the title.
