Ordinance 30790006.160.147 PAO /nkr 03/14/96 ORDINANCE NO. 3079 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ADDING A NEW SECTION 8.51.045 TO THE EDMONDS CITY CODE IN ORDER TO CREATE A SPECIAL FUND TO BE KNOWN AS THE "EMPLOYEE PARKING PERMIT FUND" FOR THE DEPOSIT OF APPLICATION FEES RECEIVED FOR EMPLOYEE PARKING PERMITS PURSUANT TO EDMONDS CITY CODE SECTION 8.51.040(E) AND LIlVIITING THE USE OF SAID FUND TO THE ADMINISTRATION OF THE EMPLOYEE PARKING PERMIT PROGRAM CREATED BY EDMONDS CITY CODE CHAPTER 8.51 AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City of Edmonds, Washington has recently created an Employee Parking Permit Program designed to divert parking for employee business owners and employees to low demand parking areas, and and WHEREAS, a requirement of this parking program is a $25.00 application fee, WHEREAS, the Edmonds Financial Department has requested the creation of a separate fund to deposit these application fees, and WHEREAS, the creation of such a fund will further the constitutional validity of the parking program by limiting the expenditure of application fees to the administration of the program, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: 126887.10 -1- Section 1. Chapter 8.51 of the Edmonds City Code is hereby amended by adding the following section: Section 8.51.045. Employee Permit Parking Fund Created. There is hereby created a special fund to be known as the "Employee Permit Parking Fund. " All application fees received by the City pursuant to Edmonds City Code Section 8.51.040(E) shall be deposited in this fund. All monies in this fund shall be used solely and exclusively for the administration of the employee permit parking program created by Edmonds City Code Chapter 8.51. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum and shall become effective five (5) days after passage and publication of an approved summary thereof consisting of the title.
