ORDINANCE NO. 3089
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, VACATING CERTAIN PROPERTY ON THE
EAST SIDE OF 12TH AVENUE NORTH IN THE CITY OF
EDMONDS, WASHINGTON, DEDICATED FOR STREET
PURPOSES AND FIXING A TIME WHEN THE SAME SHALL
BECOME EFFECTIVE.
WHEREAS, pursuant to Resolution No. 582 the City Council of the City of
Edmonds, Washington held a public hearing on September 4, 1984 to consider the proposed
vacation of certain property in the City of Edmonds, Washington, dedicated for street purposes
and located on the east side of 12th Avenue North, south of Puget Drive and north of Viewland
Drive, more particularly described as set forth on Exhibits A and B, attached hereto and
incorporated herein by this reference as if set forth in full, and
WHEREAS, pursuant to the finding of the City's Responsible Official, the City
Council finds that there will be no significant adverse environmental impacts, and
WHEREAS, at the conclusion of said public hearing, the City Council found that
said property dedicated for street purposes should be vacated in exchange for a native growth
protection easement along and adjacent to, Puget Sound Drive, the City Council does hereby
determine to vacate the same as hereinafter set forth, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. The following parcel of property previously dedicated for street
purposes is hereby vacated reserving and excepting a native growth protection easement as
shown on the subdivision plat contemporaneously recorded in the records of Snohomish County,
Washington. Said parcel is located in the City of Edmonds, Snohomish County, Washington,
along the east side of 12th Avenue North lying between Puget Drive and Viewland Drive in the
City of Edmonds, Snohomish County, Washington, as legally described and shown on Exhibits
A and B attached hereto and incorporated herein by this reference as if set forth in full.
Section 2. The City Clerk is hereby directed to file a certified copy of this
ordinance with the Snohomish County Auditor.
Section 3. Effective Date. This ordinance shall be in full force and effect five
(5) days after passage and publication by posting as provided by law.
