Ordinance 31100006.030.006B WSS /ldh /gjz 08/16/95 R:08 /20 /96gjz ORDINANCE NO. 3110 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING AND CLARIFYING ORDINANCE NOS. 2622, 2741, 2884, 2961 AND 3004 REGARDING THE MEETINGS QUALIFYING FOR COMPENSATION, INCREASING THE MAXIMUM COMPENSATION AMOUNT PAYABLE FOR FUTURE MEMBERS OF THE CITY COUNCIL AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, Ordinance Nos. 2622, 2741, 2884, 2961 and 3004 have established and clarified a method of compensation of City Councilmembers which includes a base payment of $350 per month for Councilmembers taking office after December 31, 1989, and $50 per meeting to a maximum of seven meetings or $350 per month, and WHEREAS, various ordinances define the City Council meetings which qualify as official meetings of the City Council or a meeting at which the City Council wishes to be represented and which qualify for the $50 per month payment, and WHEREAS, due to changes in meeting schedules and committee structures, as well as changes within other regional entities of which the City is a member, certain organizations have ceased to exist and their duties have been assumed by successor agencies, and WHEREAS, the City Council has established a maximum on the number of meetings qualifying for compensation in order that these changing committee structures can be recognized while meeting the intent and purpose of the provisions of the Washington State Constitution which prohibits the City Council from increasing the compensation of its members during their term of office, NOW, THEREFORE, 140653.10 -1- THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Ordinance Nos. 2622, 2741, 2884, 2961 and 3004 are hereby amended in, but only in, the following respects in order to clarify the meetings eligible for compensation. Councilmembers taking office following December 31, 1989 shall receive $350 per month as base compensation. An additional payment of $50 per public meeting actually attended shall be paid to a Councilmember to a maximum payment of $350 per month. "City Council meeting" shall mean all regular meetings of the Edmonds City Council attended by a quorum of its members, whether regular or special meetings, as well as other public meetings attended by Councilmembers as appointed representative of the City Council in the performance of their duties. The following meetings are specifically approved when attended as an assignment of a designated Councilmember or alternate: a. Cultural Arts and Convention Districts; b. Disability Board; C. Professional Consultant Selection Committee; d. SnoCom; e. Medic 7; f. Snohomish County Community Transit; g. Snohomish County Drug Enforcement Task Force; h. Edmonds Alliance for Economic Development; i. Comprehensive Human Resources Committee; j. Snohomish County Tourism Advisory Board; k. Port of Edmonds District Meeting; and 140653.10 -2- 1. Meetings of other entities or of committees of the City Council, when attendance is preapproved by the Council President for a specific City Councilmember designated as the City's representative. Approval for attendance at additional meetings may be extended by the City Council President at his or her discretion when attendance has previously been authorized by the City Council or in order to provide coverage for the Mayor or another member of the City Council who is unable to attend a public meeting at which the Council President deems City representation to be in the City's best interests. Compensation authorized by the City Council President for attendance at additional meetings under paragraph 1. above shall authorize payment regardless of whether the specific meeting is listed in this ordinance as preapproved for payment. In the event that compensation is paid directly to a City Councilmember for his or her attendance at a meeting by the public entity conducting the meeting and such compensation amount is less than the $50 per meeting approved for City Councilmembers, the Councilmember shall receive a payment from the City equal to the difference between the amount paid by the other entity and the $50 per meeting compensation authorized by this ordinance. In no event shall any City Councilmember elected to office prior to January 1, 1998, receive compensation in excess of $350 per month for meeting attendance nor total compensation from the City in excess of $700 per month. The term "compensation" as used in this ordinance shall not include the reimbursement of actual expenses incurred. Section 2. Any City Councilmember elected to office on or after January 1, 1998, shall receive compensation of $350 per month as base compensation and an additional payment of $50 per meeting actually attended in accordance with the policies established by Section 1 of this ordinance to a maximum of $400 per month. Section 3. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, 14W3.10 -3- such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
