Ordinance 31190006.160.147 WSS /gjz 11/14/96 ORDINANCE NO. 3119 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, REVIEWING A PILOT PROGRAM ESTABLISHED PURSUANT TO ECC CHAPTER 8.51 ENTITLED EDMONDS EMPLOYEE PERMIT PARKING PROGRAM, ADOPTING LEGISLATIVE FINDINGS, MAKING SUCH PROGRAM REGULARLY EFFECTIVE BY REPEAL OF A SUNSET CLAUSE ENACTED BY SECTION 2 OF ORDINANCE NO. 3068, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, Ordinance No. 3068 adopted ECC Chapter 8.51 in order to provide an exemption to certain business owners and employees from specified three -hour parking limits if such vehicles were parked as a part of a commute to work, and WHEREAS, that Ordinance contained a sunset provision requiring a report to the Edmonds City Council on or before an expiration date of December 31, 1996, and WHEREAS, such report has been made and the City Council finds it to be in the public interest to extend such program finding that it serves the needs of the City by assisting in the mitigation of traffic congestion and lessens the disruption of business activity due to employees moving vehicles in order to comply with three -hour parking limits, and WHEREAS, the City Council review finds that the areas designated for three -hour parking are, for the most part, in relatively low demand and that those areas designated for inclusion in the program which are causing neighborhood disruptions as being adjusted pursuant to another ordinance, and ,47772 -1- WHEREAS, the City Council finds that the ordinance in operation has not decreased the parking available to the general public and is consistent with the findings contained in Ordinance No. 3068, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 2 of Ordinance No. 3068 establishing a sunset provision for Chapter 8.51 is hereby repealed and the chapter continued in full force and effect from and after the date of passage of this ordinance until such time as the future Edmonds City Council shall determine it appropriate to amend or repeal such provision. Section 2. The code codifier is hereby authorized to remove Note 1 from the title of Chapter 8.51. Section 3. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 4. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
