ORDINANCE NO. 3144
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, .AMENDING SECTION 5.40.020 OF THE
EDMONDS CITY CODE BY ADDING A NEW SUBSECTION,
TO ADOPT BY REFERENCE THE STATE STATUTE WHICH
ESTABLISHES THE CRIME OF MAKING A FALSE OR
MISLEADING STATEMENT TO A PUBLIC SERVANT, AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, state legislature has made it a misdemeanor to knowingly make a
false or misleading statement to a public servant, and
WHEREAS, the City Council of the City of Edmonds wishes to adopt the state
statute, RCW 9A.76.175, which establishes said crime, by reference, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Section 5.40.020 of the Edmonds City Code is hereby amended by
adding a new subsection T, to read as follows:
5.40.020 Obstructine Justice. Criminal Assistance. Introducin
Contraband and Related Offenses. The following statutes of the
state of Washington, including all future amendments thereto, are
adopted by reference:
T. RCW 9A.76.175 Making a False or Misleading Statement to
a Public Servant.

Section 2. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.

RCW 9A.76.175 Making a false or misleading statement to a public servant.
A person who knowingly makes a false or misleading material statement to a public servant is
guilty of a gross misdemeanor. "Material statement" means a written or oral statement
reasonably likely to be relied upon by a public servant in the discharge of his or her official
powers or duties. [1995 c 285 § 32.]
