AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF SECTION
20.105.010 APPEALABLE DECISIONS, A. STAFF
DECISIONS, 3. INTERPRETATIONS OF THE TEXT OF THE
COMMUNITY DEVELOPMENT CODE IN ORDER TO
CLARIFY THAT THE APPEAL PROCEDURES ESTABLISHED
BY THE STATE BUILDING CODE ARE EXCLUSIVE, AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the Edmonds Community Development Code, Section
20.105.010(A)(3) provides for appeals of interpretations of the text of the Edmonds Community
Development Code; and
WHEREAS, the City has adopted in Title 19, and enforces the state building code
pursuant to the provisions of state statute and the Washington administrative code; and
WHEREAS, the state building code and Washington administrative code provide
for limited appeal and modification procedures; and
WHEREAS, those specific procedures have been and should be deemed exclusive
regarding the interpretation and application of the building code; and
WHEREAS, the City Council wishes to clarify that exclusive jurisdiction on
appeal; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. Section 20.105.010(A)(3) is hereby amended to read as follows:
20.105.010 Appealable Decisions.
A. Staff Decisions.
3. Interpretations of the text of the ECDC,
provided, however, that where specific appeal
procedures are provided for by this code or an
incorporated statute such as but not limited to Title
19 of the State Building Codes, such specific appeal
procedures shall control.
Section 2. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
