ORDINANCE NO. 3149
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING SECTION 18.90.040 TO
REFERENCE CHAPTER 9.20 OF THE EDMONDS CITY
CODE GOVERNING SIDEWALK MAINTENANCE AND
FIXING A TIME WHEN THE SAME SHALL BECOME
EFFECTIVE.
WHEREAS, the City of Edmonds has enacted a comprehensive ordinance
structure to govern sidewalk maintenance, and
WHEREAS, a reference in the engineering requirements of the Edmonds
Community Development Code in Section 18.90.040 is redundant and should be .better
coordinated with Chapter 9.20, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. The Edmonds Community Development Code Section 18.90.040.duly
maintained is hereby repealed and in its place a new Section 18.90.040 Sidewalk Maintenance
is enacted to read as follows:
Section 18.90.040 Sidewalk Maintenance
The duty of an adjacent property owner to maintain
a sidewalk and a planting strip are governed
pursuant to Chapter 9.20 of the City Code,
incorporated by this reference as fully as if herein
set forth.

Section 2. Severability. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
