Ordinance 31590006.130.176 PAO /gjz 01/15/97 08/04/97gjz R:08/ 18 /97gjz ORDINANCE NO. 3159 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, ESTABLISHING THE EDMONDS MEDICAL SELF INSURANCE ADVISORY BOARD, WHICH SHALL BE RESPONSIBLE FOR ADVISING THE EDMONDS CITY COUNCIL ON MATTERS PERTAINING TO THE EDMONDS SELF INSURANCE PROGRAM AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, in order to provide quality employee medical benefits at lower cost, the City of Edmonds has initiated a medical self insurance program, and WHEREAS, since this self insurance program has been adopted for the benefit of City employees, the City Council deems it appropriate to create a forum from which City employees can provide input on the self insurance program, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Title 10 of the Edmonds City Code is hereby amended by the addition of a new Chapter 10.31 to provide as follows: Chapter 10.31 MEDICAL SELF - INSURANCE ADVISORY BOARD Sections: 10.31.010 10.31.020 10.31.030 10.31.040 10.31.050 10.31.060 Title /Board Established Membership Appointment /Terms of Office Compensation Meeting Duties of Board /Purpose 169236 -1- Section 2.38.010 Title /Board Established There is established for the City of Edmonds an employee advisory board to be known as the Medical Self- Insurance Advisory Board. Section 2.38.020 Membership The Edmonds Medical Self- Insurance Advisory Board shall be composed of the following: A. One representative from each of the unions who have entered into a collective bargaining agreement with the City of Edmonds. B. One representative for the employees not represented by a union. C. The Mayor or his /her designee. D. One Councilmember or Council designee. E. The Personnel Manager. Union representatives shall be selected by their respective unions. The mayor shall appoint the representative for employees that are not represented by a union. Section 2.38.030 Terms of Office Employee representatives on the Board shall serve two year terms. Section 2.38.040 Compensation No member of the Board shall receive compensation for services performed. Reasonable expenses of the Board and its members may be provided for by budgeted funds as approved by vote of the City Council. Section 2.38.050 Meetings A. The Board shall have at least one regular meeting per month on such day of the month and at such time as may be determined by the Board, unless a specific meeting is cancelled by 169236 -2- majority vote of the Board. Special meetings may be held as often as the Board deems necessary. B. For purposes of conducting the Board's business, exercising its powers and for all other purposes, a quorum of the Board shall consist of a majority of its membership. Any action taken by a majority of those present, when those present constitute a quorum at any regular or special meeting of the Board, shall be deemed and taken as the action and decision of the Board. C. The Board shall elect such officers as it deems necessary in order to conduct its business. The Board shall adopt such rules of procedure as it deems necessary. D. The Board shall tape record or keep minutes of all meetings held and all business transacted. All records of the Board shall be open for public inspection, except those that may be exempt from public disclosure under state law. Section 2.38.060 Duties of the Board /Purpose The Board shall be responsible to the City Council for providing advice and recommendations on the policies and administration of the medical self - insurance program, the fund for which is codified in Chapter 3.10 ECC. The Board shall acquire authorization from the City Council prior to undertaking any project or formulating any recommendation. Section 3. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. 169236 -3- Section 4. Effective Date. This ordinance, being an administrative action, is not subject to referendum and shall take effect five (5) days after publication of an approved summary thereof consisting of the title.
