Ordinance 31650006.030.004 WSS /gjz 10/28/97 R:10/29/97rin R:11 /05 /97gjz R:11 /10 /97gjz ORDINANCE NO. 3165 AN ORDINANCE AMENDING THE PROVISIONS OF ECC 3.04.080 TO CONFORM TO THE PROVISIONS OF STATE STATUTE, REPEALING ECC CHAPTER 3.22 RELATING TO AN EMERGENCY AMBULANCE SERVICE EXCISE TAX, REPEALING THE PROVISIONS OF ECC 2.70.040 AND 2.70.050 AND CREATING A NEW SECTION 2.70.040 TO PROVIDE FOR A NEW BASIS FOR CONTRIBUTION, AMENDING THE PROVISIONS OF ECC 6.60.030 TO DELEGATE DUTIES TO THE SNOHOMISH COUNTY EMERGENCY SERVICES COORDINATING AGENCY AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City has recently received the report of the Washington State Auditor providing the City with an unqualified clean opinion regarding its financial health, and WHEREAS, the State Auditor made certain recommendations in his management letter regarding the need to revise and update certain provisions of the city code to comport with changes in state statute, and WHEREAS, the City Council deems it to be in the public interest to make small nonsubstantive changes to the City Code in order to comply with the auditor's recommendations, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: 177365.1 -1- Section 1. Edmonds City Code Section 3.04.080 Credit Cards is hereby amended to read as follows: 3.04.080 Credit Cards. In accordance with the provisions of RCW 43.09.2855 as the same exists or shall hereafter be amended authorizing political subdivisions to use credit cards for official government business, the Finance Director is hereby authorized to obtain two credit cards from the City's designated official bank with a limit of $5,000. One card shall be assigned to the Mayor for expenses relating to City business; provided, however, that the card shall not be used for the purchase of goods or services. The other card shall be assigned to the Finance Director for safe keeping and control. The Finance Director shall establish a credit card system for City employees to use the credit card for costs associated with registering for lodging. No other cost or expenses, including actual expenses, shall be incurred on the card under the finance director's control. Section 2. The Edmonds City Code is hereby amended by the repeal of ECC Chapter 3.22 relating to emergency ambulance service excise tax. Section 3. The Edmonds City Code Chapter 2.70 is hereby amended by the repeal of Section 2.70.040 Basis for Social Security Coverage, and 2.70.050 Basis for Contributions, enacting in their place a new Section 2.70.040 to read as follows: 2.70.040 Basis for Contributions. The basis for contributions shall be established by and in accordance with the provisions of the retirement system. Section 4. The Edmonds City Code Section 6.60.030 Office of Disaster Coordinator Created is hereby repealed and in its place enacted a new Section 6.60.030 Disaster Coordination Duties Delegated to read as follows: 6.60.030 Disaster Coordination Duties Delegated. The duties of the office of disaster coordinator are hereby delegated to the Snohomish County Emergency Services Coordinating Agency (ESCA). 177365.1 -2- Section 5. Severability.. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 6. This ordinance is a legislative act delegated by statute to the City Council of the City of Edmonds, is not subject to referendum and shall take effect five days after passage and publication of an approved summary thereof. (1) Local governments, including counties, cities, towns, special purpose districts, municipal and quasi - municipal corporations, and political subdivisions, are authorized to use credit cards for official government purchases and acquisitions. (2) A local government may contract for issuance of the credit cards. (3) The legislative body shall adopt a system for: (a) The distribution of the credit cards; (b) The authorization and control of the use of credit card funds; (c) The credit limits available on the credit cards; (d) Payment of the bills; and (e) Any other rule necessary to implement or administer the system under this section. (4) As used in this section, "credit card" means a card or device issued under an arrangement pursuant to which the issuer gives to a card holder the privilege of obtaining credit from the issuer. (5) Any credit card system adopted under this section is subject to examination by the state auditor's office pursuant to chapter 43.09 RCW. (6) Cash advances on credit cards are prohibited.
