ORDINANCE NO. 3194
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, AMENDING THE PROVISIONS OF THE
EDMONDS COMMUNITY DEVELOPMENT CODE SECTION
16.60.010(D) TO RESTORE AS A SECONDARY'
CONDITIONAL USE OF THE GENERAL COMMERCIAL
ZONE OUTSIDE RETAIL USES, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, Ordinance No. 3100 amending the provisions of chapter 16.50 and
16.60 to provide for community oriented open air markets; and
WHEREAS, prior to the passage of Ordinance No. 3100 outdoor uses were
permitted in the general commercial (CG) zone with a conditional use permit; and
WHEREAS, there was no recommendation by the Edmonds Planning Board to
delete this use nor did the City Council act to delete a secondary use, therefore, the passage of
Ordinance No. 3100 which amended 16.60.010(D)(1) in such a fashion as to eliminate pre-
existing conditional use for outdoor business is a scrivener's error and an unattended
consequence of the passage of the Ordinance No. 3100; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
Section 1. The Edmonds Community Development Code Section 16.60.010(D)
relating to secondary conditional uses in the general commercial (CG) zone is hereby amended
by the restoration and addition of a new sub - paragraph 5.

5. Secondary outdoor service or retail uses
secondary to the primary on -site use.
Section 2. Severabilitv. If any section, sentence, clause or phrase of this
ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction,
such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this ordinance.
Section 3. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
