Ordinance 31950006.90000 WSS /gjz 03/06/98 R:03 /10 /98gjz R:03 /11 /98gjz R:03 /12 /98gjz ORDINANCE NO. 3195 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE EDMONDS CITY CODE SECTIONS 7.30.040, SEWER UTILITY CHARGES, TO PROVIDE FOR INCREASES TO BE EFFECTIVE APRIL 1, 1998 AND JANUARY 1, 1999, REPEALING SECTION 7.50.050 AND ENACTING IN ITS PLACE A NEW SECTION 7.50.050 ESTABLISHING RATES AND CHARGES FOR THE STORM WATER UTILITY TO BE EFFECTIVE APRIL 1, 1998 AND JANUARY 1, 1999 AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City Council has received the report of its consultant recommending such rate increases as would be necessary to cover the costs to the combined utility in order to provide for the cost of maintaining the sewer utility and storm water utility and WHEREAS, following public hearings, the City Council has determined that economic prudence requires the increase of certain utility rates in order to maintain the economic viability of its utility funds, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 7.30.040 relating to utility charges for sewer service is hereby amended to read as follows: 189997. 1 -1- 7.30.040 Utility Charges (Sewer) The utility charges for sanitary sewer service set forth in this section shall be added to and made a part of the bi- monthly or monthly rates for water supplied through the meters as set forth in ECC 7.30.030; A. For customers who are served by city waterlines, the following charges are imposed: Effective Connected Uncon- nected 1.Single- family residences (bi- monthly) 4/1/98 $38.30 $7.08 1/1/99 $43.94 $7.08 2.Duplex, apartment houses, condominiums and other multi -unit residences (bi- monthly) 4/1/98 $30.78 $7.08 /unit 1/1/99 $35.30 $7.08 /unit 3.Duplex, apartment houses, condominiums and other multi -unit residences (monthly) 4/1/98 $15.39 $3.54 /unit 1/1/99 $17.65 $3.54 /unit 4. All other customers (monthly) Fixed Rate: 4/1/98 $2.19 $3.54 1/1/99 $2.51 $3.54 Volume charge 4/1/98 $2.48 /ccu* N/A 1/1/99 $2.84 /ccu* N/A *Per 100 cubic feet of metered water consumption. B.For customers who are not served by city waterlines but who are connected to city sewers, the charges shall be the same as set forth in paragraph A and its subparagaraphs. C.These rates do not apply to industries or manufacturing concerns which have industrial wastes. These, together with other activities not covered in this chapter, shall be dealt with on a special basis 199997.1 -2- and have special rates set for the particular business by the water /utility administrative staff, subject to review and approval by the city council. D.All property owners within an area served by a sanitary sewer system in the city of Edmonds are hereby directed and compelled to connect their private drains and sewers to the city system. Failure to do so within 30 days of written notice to connect by the city shall subject the property owner to a monthly penalty equal to that charge imposed by subsections A, B and /or C above. Said penalty shall be billed to the property owner, and they shall be subject to payment, collection and enforcement in all respects as though they were utility customers of the city. All penalties collected shall be considered revenues of the sewer utility system. Section 2. The Edmonds City Code is hereby amended by the repeal of Section 7.50.050, Rates and Charges, and its reenactment in the following format: 7.50.050 Rates and charges The following rates shall be charged effective on the date shown to the following classes of customers and /or service: 1. Single- family residential. Effective April 1, 1998, $7.40 /bi- monthly. 2. Multi - family residential. Effective April 1, 1998, $3.70 /ESU /monthly or $7.40 /Esu /bi- monthly. 3. All non - residential customers. Effective April 1, 1998, $3.70 /ESU /monthly. 4. An ESU is hereby defined to be the impervious surface area estimated to contribute an amount of runoff which is approximately equal to that created by the average single - family residential parcel. A single - family residential parcel is one ESU. For all other parcels, one ESU is equivalent to 3,000 square feet of impervious surface area. Section 3. The City staff is directed to report to the City Council on or before April 1, 1999 regarding its review of the approved rates and whether adjustments are appropriate is9M.1 1 -3- to achieve equity between classes of rate payers. Section 4. Severabil4. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 5. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
