Ordinance 32090006.90000 WSS /gjz 02/23/98 R:03/24/98gjz R:04 /01 /98gjz R:04 /02 /98gjz ORDINANCE NO. 3209 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF CHAPTER 20.60 RELATING TO SIGN PERMITS TO PROVIDE FOR AN INTERIM STUDY PERIOD REGARDING A -FRAME AND SANDWICH BOARD DIRECTIONAL SIGNS, DESIGNATING A SIX -MONTH STUDY PERIOD, DIRECTING ENFORCEMENT PRIORITIES, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, there has been a proliferation of A -frame and sandwich board and other free - standing signs in all business districts of the City of Edmonds, and WHEREAS, such signs are prohibited in the public right -of -way and frequently violate the maximum sign area provisions of the City Code as well as the regulatory provisions of Section 20.60.080 relating to temporary signs, and WHEREAS, the City Council wishes to provide for a temporary study period in which A -frame and sandwich board signs may be located on private property and in the public right -of -way which abuts said private property, but outside of required fire exits and corridors as an exception to the maximum sign area limitation in order to provide for direction of the public to the owner or lessee's place of business, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: 188727 -1- Section 1. Chapter 20.60 is hereby amended by the addition of a new sub - section 20.60.080 Temporary Signs (T) Sandwich Board and A- Frame Signs 20.60.080 Temporary Signs. (J) Sandwich Board and A -Frame Signs. One (1) sandwich or A -frame sign meeting the standards of sub - section B above, may be maintained on private property and in the public right -of -way which abuts said private property in order to provide direction to a business or other permitted use related to the property for the convenience of the public provided, however, that such signs shall comply with all the provisions of this chapter, including but not limited to the requirement that no sign be located in a public right -of -way including sidewalks in such a manner that: (i) it constitutes a barrier to pedestrian passage, or (ii) risk of physical injury, or (iii) impairs public safety, or (iv) violates requirements of the State Building Code that no such sign shall block or otherwise impede the use of required fire exits and exiting corridors. Section 2. This ordinance is enacted as an interim zoning ordinance of the City. In accordance with the provisions of RCW 36.70A.390, a hearing shall be held on May 19, 1998 such date being within sixty (60) days of enactment. This ordinance shall expire on its terms and be void six months from and after its effective date unless the City Council moves to incorporate it in the zoning ordinances of the City of Edmonds or extends the interim zoning ordinance by separate legislative action with such public hearing and notice as is required by state law. Section 3. During the period in which the interim zoning measure is in effect, the 188727 -2- Mayor, through her code enforcement personnel, is requested to direct enforcement efforts toward signs which impede the public's use of public sidewalks, which either: (A) block fire exits, impair public safety, or otherwise create a risk of physical injury, or (B) which are placed in a location apart from the sign owner's private property. Any sign placed in violation of this ordinance shall be confiscated as soon as it is noted to protect the safety of all pedestrians and to preserve the rights of other property owners. Section 4. Effective Date. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
