ORDINANCE NO. 3225
AN ORDINANCE OF THE CITY OF EDMONDS,
WASHINGTON, VACATING A SLOPE EASEMENT
DESCRIBED IN AUDITOR'S FILE NO. 78905090295 AND
STREET VACATION FILE ST- 98 -74, AND FIXING A TIME
WHEN THE SAME SHALL BECOME EFFECTIVE.
WHEREAS, a slope easement was dedicated to the City without compensation as
part of the improvements of 5th Avenue South, and
WHEREAS, the City's staff reports that such easement is surplus to the needs of
the City, that there is no reasonable likelihood that said easement will be used for public
purposes, and that such easement should be vacated in order to permit full and appropriate use
and development of the subject site which it burdens, NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Following notice of a public hearing on September 14, 1998, the City
Council does hereby determine that it is in the public interest to vacate said easement.
Section 2. The City Clerk is hereby authorized to file a copy of this ordinance
of record at the City's cost in the land records of Snohomish County in order to effectuate said
vacation.

Section 3. Given the nature of this easement and the fact that .:there is no record
that compensation was paid for its acquisition, the City Council hereby deems it appropriate to
waive compensation for this action.
Section 4. Effective Date. This ordinance, being an exercise of a power specifi-
cally delegated to the City legislative body, is not subject to referendum, and shall take effect
five (5) days after passage and publication of an approved summary thereof consisting of the
title.
