Ordinance 32540006.900000 WSS /sds /gjz 05/24/99 ORDINANCE NO. 3254 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 1 OF ORDINANCE NO. 3248 TO CLARIFY THE APPLICATION OF THE ZONING MORATORIUM REGARDING ENFORCEMENT ACTIONS RELATING TO THE KEEPING OF ANIMALS; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Ordinance No. 3248 imposes a zoning moratorium on the enforcement of the provisions of ECDC 16.20.010(b)(4) and (5) and ECDC 16.30.010(b) and secondary applications through Edmonds City Code Chapter 5.05.130; and WHEREAS, it is the intent of the City Council that the City's animal control officer remain fully able to enforce the provisions of Chapter 5.05 relating to animal control and the City's authority to abate or prosecute actual nuisances or threats to public health, safety and welfare, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON DO ORDAIN AS FOLLOWS: Section 1. Ordinance No. 3248, Section 1 is hereby amended in, but only in the following respects. The last sentence of such section is hereby amended to read as follows: Nothing herein shall be interpreted to suspend, limit, or prohibit the application of the remaining provisions of Chapter 5.05 of the City's Codes relating to animal control provisions nor to prohibit the City from taking immediate action to abate or prosecute an actual nuisance or threat to the public health safety and welfare -1- WSS233943.10 arising from any dangerous or unregulated animal pursuant to said Chapter 5.05 or any of the other provisions of City Code or State law. In all other respects, the provisions of Ordinance No. 3248 shall remain in full force and effect. Section 2. Effective Date. The provisions of Ordinance No. 3248 as a zoning moratorium shall expire six (6) months from and after its effective date of May 11, 1999, that is, on or about November 10, 1999. This ordinance, being an exercise of a power specifically delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
