Ordinance 32580006.150.147 CDI /hrg 06/17/98 R:04 /19 /99gjz ORDINANCE NO. 3258 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING SECTION 20.90.010 OF THE EDMONDS COMMUNITY DEVELOPMENT CODE, APPLICATION PROCEDURES, RELATING TO APPLICATION PROCEDURES FOR DEVELOPMENT PERMITS OR OTHER CITY APPROVALS UNDER THE ECDC, BY ADDING A NEW SUBSECTION ECDC 20.90.010(D)(4), ESTABLISHING A TIME LIMIT FOR COMPLETION OF INCOMPLETE APPLICATIONS AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City of Edmonds requires applicants for development permits and other City approvals to submit completed forms to the City under ECDC 20.90.010; and WHEREAS, ECDC 20.90.010 requires the City to inform an applicant when their application is incomplete by written notification; and WHEREAS, ECDC 20.90.010 does not specify a time limit for completing an application following notification of incompleteness with the City; and WHEREAS, the City Council finds that it is in the best interest of the City to expedite applications and to require applicants to complete their applications in a timely manner; and WHEREAS, six months has been determined to be an appropriate length of time to permit applicants to complete their incomplete applications; NOW, THEREFORE, 201119.10 -1- THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds Community Development Code Section 20.90.010 is hereby amended by adding a new subsection ECDC 20.90.010(D)(4) to read as follows: 20.90.010 Application Procedures. D. Letter of Completeness. 4. Applicants whose applications have been determined to be incomplete shall submit the specified information within six months after the city deposits a written statement detailing the reasons that the application is incomplete in the U.S. mail, postage paid. A Determination of Incompleteness is a staff decision appealable under Chapter 20.105 of the ECDC. If the specified information is not submitted within the six month period, then the application shall be rejected for incompleteness. Following the initial notification of the applicant in writing that his or her application is incomplete, the applicant shall receive one, and only one, six -month opportunity to correct the application; no further notice shall be required and the six -month correction period shall not be extended. After rejection for incompleteness, an application shall not be revived, but the applicant may submit a new application under the provisions of this chapter. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the 201119.10 -2- title.
