Ordinance 32700006.900000 WSS /gjz 7/21/99 ORDINANCE NO. 3270 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF ECC SECTION 4.12.055 STREET VENDOR REQUIREMENTS, PARAGRAPH (D) TO PROHIBIT THE OVERNIGHT STORAGE OF INVENTORY OR OTHER SALES RELATED MATERIAL ON ANY PUBLIC STREET, PUBLIC PLACE OR PUBLIC LOT, EXCEPT AS PROVIDED HEREIN, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City's street vendor requirements are intended to license individuals who go from place to place within the City or who solicit sales from individuals on public ways and places; and WHEREAS, businesses are prohibited from outside storage or activities when operating from a fixed location or place of business pursuant to City ordinance; and WHEREAS, the City Council finds that the storage of inventory, equipment or other materials related to the solicitation and sales process by solicitors and street vendors create a visual blight on the City, can constitute a safety hazard and would otherwise be in conflict with the more restrictive provisions of the zoning code as they relate to established places of business operating from fixed locations, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: {WSS405475.DOC;1 /00006.900000/} - 1 - Section 1. Section 4.12.055 Street Vendor Requirements, paragraph D is hereby amended to read as follows: 4.12.055 Street Vendor Requirements D. The vending site shall be kept clean and orderly at all times, and the vendor must provide a refuse container. No portion of a vendor's 'inventory, sales equipment, or any other structure or equipment used in the sales or solicitation process shall be left overnight upon any unenclosed portion of any lot or site within the City, nor upon any public street or right -of -way without the issuance of a street use permit for a mobile vending unit issued pursuant to ECC 45.12.030(B) and (C). Section 2. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
