Ordinance 32740006.900000 WSS /gjz 7/20/99 ORDINANCE NO. 3274 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE PROVISIONS OF SECTION 19.97.030 GENERAL PROVISIONS (B) BASIS FOR ESTABLISHING THE AREAS OF SPECIAL FLOOD HAZARD AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, the City of Edmonds pursuant to federal mandate has adopted a Flood Plain Management Program; and WHEREAS, the Federal Emergency Management Administration has issued new maps for the National Flood Insurance Program which were preliminarily approved and effective January 30, 1998; and WHEREAS, the City Council deems it to be in the public interest to amend the Federal Management Program to adopt the information set forth in the maps and in accordance with the requirements of the Program, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The Edmonds Community Development Code Section 19.97.030 General Provisions, Paragraph B, Basis For Establishing the Areas of Special Flood Hazard is hereby amended to read as follows: {WSS405253.DOC;1 /00006.900000/1 - 1 - Section 19.97.030 General Provisions. B. Basis for Establishing the Areas of Special Flood Hazard. For the purposes of this Chapter, the areas of special flood hazard for the City of Edmonds are hereby declared generally to be those areas shown as "Zone A" on the map designated flood insurance rate map, City of Edmonds, Washington, Snohomish County, and shown on the following maps or panels: 53061C00; 5306IC1292 E — Panel 1292; 53061CI285 E — Panel 1285; 5306101315 E — Panel 1315; and 53061CI305 E — Panel 1305. The following maps and panels were revised and effective on January 30, 1998, and such maps and panels are adopted by this reference as part of this Chapter as if fully set forth herein. Base flood elevations and floor hazard factors for those areas shown on Zone A on the maps have not been determined and the Local Flood Management Administrator shall utilize such other data as may reasonably be available for the federal, state or other sources in administering this Chapter as provided in ECDC 19.97.040(E). The Flood Insurance Rate Map and the panels thereof are on file in the office of the City Clerk. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
