Ordinance 3277ORDINANCE NO. 3277 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING ECDC 19.00.010(F) RELATING TO THE EXPIRATION OF BUILDING PERMITS, AND FIXING A TIME WHEN THE SAME SHALL BECOME EFFECTIVE. WHEREAS, ECDC 19.00.010(F) currently provides that a permit issued by the building official may be extended once for a single one -year period if application is made prior to expiration of the original permit; and WHEREAS, the practical time period necessary for completion of many construction projects indicates that an additional extension period of another year is desirable and would eliminate the unnecessary costs and administrative time required to process a new permit to recommence work under an expired permit; WHEREAS, the building official and council committee on community development have recommended that such section be amended to allow for a second extension for an additional one -year period if application is made prior to expiration of the first extension; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Amendment. Edmonds Community Development Code, Section 19.00.010(F) is hereby amended as set forth below: F. Expiration and Extension. Every permit issued by the building official under the provisions of ECDC Title 19 shall expire and become null and void one year from the date of issuance except for those permits provided below, which shall -1- expire 180 days from the date of issuance. In order to recommence work on an expired permit, a new permit application with full fees shall be submitted to the city. New permit applications shall be reviewed under current zoning and building codes in effect at the time of complete application submittal If a new permit is sought to recommence work on an expired permit, the new Permit shall not be considered to be vested under the codes in effect at the time of complete application for the expired permit When additional plan review is required, 121an review fees shall be charged as outlined in Chapter 15.00.020. 1. Demolition permits required by ECDC 19.00.050. 2. Permits required for moved -in buildings required by ECDC 19.35.000. 3. Mechanical permits. 4. Tank removal, fill or placement permits. 5. Grading, excavation and fill permits. 6. Water service line permits. 7. Plumbing permits. 8. Deck and dock permits. 9. Fence permits. 10. Re -roof permits. 11. Rockery and retaining wall permits. 12. Hot tub and swimming pool permits. 13. Sign permits. The building official may reject such application for extension where the building official determines that modifications or amendments to the applicable zoning and building codes have occurred since the original issuance of the permit; which modifications or amendments would significantly promote public health and -2- safety if applied to the project through the issuance of a new permit extension, if granted, sha4 -e„' allowed enee. If the plans and specifications for the a permit extension application are the same as the plans and specifications submitted for the original permit application, the permit fee shall be one -half the amount required for a new permit, otherwise the full fee, including plan review fees, shall be required. Full permit fees are required to restaA recommence work on any expired permit. A second permit extension may be granted for an additional year, subject to the same criteria and requirements for an initial extension, as set forth above. The applicant for a second extension must demonstrate that significant work has been performed pursuant to the permit extension and that there has been at least one inspection conducted by the city building inspector since the issuance of the initial permit extension In lieu of permit fees for the second extension, inspection fees shall be charged for the remaining work based on the number of required inspections for the project. The inspection fee rate is established in ECDC 15.00.020. Two extensions for a total period of two years is the maximum amount of time any building permit may be extended. At the end of any three year period starting from the original date of permit issuance, the permit shall become null and void and a new building permit shall be required. will full fees, in order for the applicant to complete the work. The issuance of a new permit shall negate all previous vesting of zoning or building codes. Whenever an appeal is filed and a necessary development approval is stayed in accordance with ECDC 20.105.020(B), the time limit periods imposed under this section shall also be stayed until final decision. This section is intended to replace Section 106.4.4 of the Uniform Building Code. Section 2. Severability. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance, being an exercise of a power specifi- cally delegated to the City legislative body, is not subject to referendum, and shall take effect five (5) days after passage and publication of an approved summary thereof consisting of the title.
